RECOMMENDATION
That Council note the report by the Property Advisor to the Services & Organisation Committee
meeting dated 7 March 2017 and authorise the Chief Executive Officer (CEO) to:
A. Write to the Queensland Government (DNRM) confirming Council’s support of their
proposed compliance action to ensure its lease holders remain within approved lease
areas and uses are for marine facilities purposes;
B. Write to commercial jetty leaseholders along Gympie Terrace advising them to cease
encroachments onto reserve land; and
C. Seek to develop a Memorandum of Understanding between DNRM and Council to
establish:
1. a regular compliance inspection program of commercial river leases identified in
Figure 1 of the report; and
2. a process by which the parties consult prior to consenting to any new sub-leases or
uses.
REPORT
Background
The Noosaville Foreshore area is one of the most popular recreational areas in the shire. The
parks and community facilities on the southern bank of the Noosa River, principally along Gympie
Terrace, are highly utilised by locals and visitors, and surrounding areas are established as key
accommodation and restaurant precincts.
Upgrades made by Council to the foreshore parks and infrastructure in the year 2000 were very
successful and contributed to escalating recreational use. The area now accommodates
significant competing recreational and commercial demands, particularly during peak holiday
times.
The Noosaville foreshore area is comprised of a series of recreational parks and adjacent road
reserve. The parks extend from Chaplin Park in the west to Pelican Beach Park to the east (see
layout included as Attachment 1). The parks are State land dedicated as recreation reserves,
with Council the nominated trustee. Council’s role as trustee is to manage the land and ensure
any uses are consistent with the recreation reserve purpose.
A number of longstanding State commercial jetty leases are also established along the foreshore.
In total there are 14 commercial leases between the Tewantin Memorial Park to the west and the
Sofitel Hotel (Noosa Parade) to the east - see Figure 1 below. The leases are predominantly
over water (i.e. beyond the high water mark) but most include a portion of foreshore land.
