SERVICES & ORGANISATION COMMITTEE MEETING AGENDA 7 MARCH 2017
Increasing recreational use of the foreshore has supported increasing commercial activity from
within the leases.
Figure 1 – Commercial Jetty Lease Locations
The Department of Natural Resources & Mines (DNRM) issues the leases and is responsible for
their management. Most leases were recently renewed for 30 years. New lease conditions
decreased the specificity of previous conditions that limited number of vessels and intensity of
use. However, standard lease conditions still require:
• Use the lease for marine facility purposes only;
• Compliance with State & Local Government laws;
• Lessees to obtain necessary approvals for structures; and
• Development and use of the land to be consistent with the Planning Scheme and
requirements of Council.
DNRM does not specifically define marine facilities purposes but recent amendments to The
Noosa Plan have included a definition, further detailed below.
Noosa Plan Provisions
Under The Noosa Plan the land along the foreshore area is zoned Open Space Conservation,
with the portions of the leases extending over the water taking on the same zoning as the
adjacent foreshore. The intent of the Open Space Conservation Zone is to maintain the natural
open space environmental values of the area, which warrant conservation and for these areas to
be appropriately managed to the general exclusion of development.
Amendments to The Noosa Plan that took effect in October 2016 further support this zoning
intent and specifically require the following:
O27 Commercial development on and adjacent to the Noosa River is designed to:
a) Provide for uses for marine facility purposes only;
b) Be compatible with the scenic values of the waterway;
c) Provide a high level of amenity, including ensuring low ambient noise levels;
d) Not increase the overall scale and intensity of commercial operations;
e) Ensure no additional commercial leases on the Noosa River;
