H.    Specify the minimum service frequency for recycling containers for recyclable material as
      once per fortnight, with provision for additional services or special services at the request of
      the owner, to a frequency as determined by the Chief Executive Officer depending upon
      the location of the premises requesting the service; and
I.    Specify the minimum service frequency for garden waste recycling containers containing
      recyclable garden waste as once per fortnight, where they are located in the 3 bin waste
      collection service area or the optional garden waste service area.



REPORT
This report is presented following legal advice from King and Company recommending that
Council adopt a number of resolutions to support the new Local Law No.7 (Waste Management)
2018 recently made by Council in March 2018. These resolutions relate to defining:
    the waste collection area where collection services will be provided,
    the recycling collection area where recycling collection services will be provided,
    the 3 bin collection service area where a 3 bin service will be provided,
    the optional service area where a garden waste recycling service will be provided, and
   the approved standard waste containers that are approved for use in Noosa Shire.
The resolutions proposed in this report consolidate previous decisions of Council and are
necessary to reflect the change in the head of power for waste management in Noosa from State
Government Legislation to the new Local Law.

1.    Background

Council was advised by State Government in 2017 that it intended to repeal Section 7 - Waste
and Recycling Regulations 2011 and Chapter 5A - Environmental Protection Regulations 2008,
effective from 1 July 2018, dealing with waste management and recommending that Council
replace the legislation being repealed with a local law.

Council proposed to make Local Law No.7 (Waste Management) 2017 and implemented local
law making procedures including:
 Referral to State Government entities for any conflict with State interests; and
   Subsequent referral to interested industry stakeholders, community groups and the local
     community.

Council subsequently resolved to make Local Law No.7 (Waste Management) 2018, at its
Ordinary Meeting on 15 March 2018.

2.    Previous adoption of 3 bin waste collection service

Council resolved to define a 3 bin collection area in April 2017 in preparation for the
commencement of the new waste management contract from 1 September 2017 and provide a
fortnightly garden waste recycling bin service for single domestic residences and duplexes.
Council also agreed to continue to provide an optional garden waste recycling service to other
premises. The head of power to adopt these service areas was contained in State Legislation at
the time.
