SERVICES & ORGANISATION COMMITTEE MEETING AGENDA 10 APRIL 2018

REPORT
1. Legislative authority to make and amend local laws

By virtue of s28 of the Local Government Act 2009, a local government may make and enforce
any local law that is necessary or convenient for the good rule and local government of its local
government area. However, this authority has a number of exceptions and limitations, which are
further prescribed by the Act.

Council’s current suite of local laws became effective on 1 July 2015. These local laws are based
on the model local laws as drafted by the State Government and notified by way of Government
Gazette on 25 June 2010. The model local laws were developed to assist local governments by
covering a range of matters considered appropriate for a local government to regulate in a simple
and consistent format.
