SERVICES & ORGANISATION COMMITTEE MEETING AGENDA 10 APRIL 2018

3. Additional amendments post October 2017

Since the Ordinary Meeting of 19 October 2017, further amendments to the local laws have been
identified for inclusion, which is the reason why the amending local laws are presented back to
Council prior to commencing public consultation. The further amendments are summarised in the
table below and included within the proposed Administration and Other Subordinate Local Laws
(Amendment) Subordinate Local Law (No. 1) 2018 (provided at Attachment 2).

April 2018 amendments to Administration and Other Subordinate Local Laws (Amendment)

                                                       Area; and Laguna Lookout carpark.

Table 2: Summary of April 2018 amendments proposed to Council

There have been no changes to the Administration and Other Local Laws (Amendment) Local
Law (No. 1) 2018 (provided at Attachment 1) to the version presented to Council in October 2017
other than updating the references to 2017 to 2018.

Nomination of State Government Controlled Roads

The purpose of this amendment is to enable the provisions of the local laws where there is
reference to a ‘road’ to apply to apply to all State Controlled roads in the Local Government area.

Failing to have the state controlled roads nominated would prevent Council from undertaking any
compliance and enforcement activity under the relevant local laws in relation to matters on a
state controlled road.

Election Signage

As it currently stands, Council’s Subordinate Local Law No. 1 (Administration) 2015 provides no
self-approval criteria for election signage on private land. The proposed amendment rectifies this
situation. Whilst Council will note that the proposed approval criteria is quite broad, King and Co
have advised that any additional regulation will raise enforceability issues capable of challenge
on the grounds of implied constitutional right to freedom of political communication.

Regulated Parking for National Park Carparks

The Department of National Parks, Sport and Racing (DNPSR) has initiated discussions with
Council’s Local Laws Manager and Director of Community Services with a view to formalising
arrangements that would allow for consistent management of parking across Noosa Heads by
including the Noosa National Park day-use carpark and Laguna lookout carpark within Council’s
designated off street regulated parking. DNPSR has also requested that a number of other
National Park carparks within the Shire also be capable of regulation by Council.
