PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 12 DECEMBER 2017
Application History
The development application has been subject to two changes. Originally a development
application for a Material Change of Use for Retail Business Type 6 – Hardware, Retail Business
Type 7 – Garden & Lifestyle Centre and Industrial Business Type 2 – Production, Alteration,
Repackaging and Repairing (Low Impact Industries & Service Industries) situated at 101
Eumundi Noosa Road, Noosaville was submitted to Council and properly made on 28 October
2016.
The applicant suggested the uses being applied for generally reflect the uses that have occurred
on the land, either currently or historically and that the proposed uses are generally consistent
with the current development approval (TPC 658) and the existing Pool Shop use.
The application proposed to retain the existing commercial building/use areas and indicated the
following site improvements would accompany the proposal:
“new northern access clear of the existing access over the adjoining land to the north
(Klinge land);
new sealed parking and manoeuvring areas and provision for 21 sealed carparking spaces
and gravel hardstand area for any overflow parking, if required;
maintenance works for the existing outdoor display area with provision for at least 2.0m of
landscaping to the frontage;
additional landscaping to the frontage in front of the existing building, extending partly
within the road reserve, in a similar manner to that existing, but being improved;
removal of all asbestos from the existing building, with new fascia, guttering and roofing to
be provided; and
New lightweight cladding and render to existing walls.”
Acknowledging the existing use rights, reuse of the existing building, various site improvements
and retention of approved gross floor areas/use areas, Council officers generally indicated their
support for the application. Council officers did express concern in respect to the extent and
range of industrial uses proposed given the site’s residential zoning.
Upon undertaking a dilapidation report and following discussions with Council officers relating to
the nature of the industrial uses being proposed, the applicant decided to change the proposal.
The dilapidation report revealed that the existing building contains a significant amount of
asbestos and is otherwise in poor condition. The applicant indicated that the existing building will
need to be demolished and replaced by a new building and subsequently requested Council to
suspend any further assessment of the application.
On 13 June 2017, the applicant submitted a change to the application. The amended application
sought the following approvals:
Preliminary Approval to Reconfigure a Lot (Boundary Realignment); and
Development Permit for Material Change of Use of Premises - Retail Business Type 6 -
Hardware & 7 - Garden & Lifestyle Centre, Commercial Business Type 1 - Office and
Industrial Business 2 - Production, Alteration, Repackaging & Repairing (limited to Service
Industries).
The reconfiguration of the lot related to a realignment of the common boundary of 101 & 105
Eumundi Noosa Road and intended to create two rectangular shaped lots. The applicant
suggested the realignment removes the irregular boundary allowing for proposed Lot 101 to
better accommodate the proposed Material Change of Use while increasing the usability of Lot
105 to accommodate a future residential use.
