PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 12 DECEMBER 2017
Similar to the original proposal, the applicant suggested that approval is sought for the various
uses to rationalise existing use rights over the land at 101 Eumundi Noosa Road while obtaining
retrospective approval for the pool shop and associated display area.
The amended application included a proposal to demolish the existing commercial building and
other associated sheds and redevelop the site entirely. A new split design, two storey commercial
building with a gross floor area of 710m2 was proposed. Approval was also sought for a 355m2
outdoor display area. Proposal plans are provided in Attachment 2.
The amended proposal also provided various improvements to the site when viewed from
Eumundi Noosa Road including an improved interface between adjoining residential uses.
Revitalised landscape areas, driveway and carparking upgrades and a stormwater detention
basin formed part of the application.
The application was to be considered by Council at the Planning and Environment Committee
meeting of 10 October 2017, and was recommended for refusal for various reasons which
primarily include:
The proposed development is inconsistent with The Noosa Plan’s zoning intent for the site
for multiple housing forms which retain a high level of residential amenity, design quality
and safety;
The proposed redevelopment of the site would have resulted in an intensification and
expansion of commercial and industrial uses in an area which is intended to be developed
for multiple housing; and
Over time it is considered that sites with non-conforming uses, will be redeveloped in line
with the zoning intent in place at the time.
Prior to Council considering the application, the applicant submitted a change to the application.
The changed application consists of the current proposal for Council’s consideration (Attachment
1).
3. ASSESSMENT

any Preliminary Approval Overriding the Planning Scheme for the land;
the Planning Scheme for the local government area; and
Any Temporary Local Planning Instrument in place for the local government area.
Of these, the statutory planning instruments relevant to this application are discussed in the
