RECOMMENDATION
That Council note the report by the Manager, Development Assessment to the Planning &
Environment Committee Meeting dated 12 December 2017 regarding the waiver or partial waiver
of development application charges for 1 April 2017 to 30 September 2017 as detailed in the
Report.
REPORT
As part of Council’s budget each year, Council adopts its Fees and Charges for the financial
year, including its regulatory and commercial charges for lodgement of development applications.
The fees and charges policy for development applications cover a number of policy provisions
including delegation to the Director, Environment & Sustainable Development to “partially or
wholly waive a development fee where strict application of the scheduled fee is obviously
unreasonable for the type of application being received.”
This report identifies proposed applications where a fee variation has been granted for the last 6
months. Between 1 April 2017 and 30 September 2017 there were 2 proposed applications
where a partial waiver or full waiver of the development application fees was granted. The tables
below set out a summary of each application and the reason for the fee waiver.

RAP15/0033 Chris Clout GIA for Detached House $542 $0
Design
An approval was given for a Detached House at 25 Lorikeet Drive, Peregian Beach. After construction
commenced, complaints were received from the neighbours concerned that the approved works would
impact on their amenity.
Review of the approved plans identified that while the issue had been considered by the officer, the
officer had inadvertently relied on information in their assessment that was misleading and had not
appropriately conditioned the development. Inspection showed that the approved plans for the detached
house would result in significant impacts on neighbouring resident’s amenity.
Council officers subsequently worked with the owners and the owner’s architect to achieve changes to
the plans to address neighbouring amenity concerns. Given the co-operation shown by the owners to
make changes it was agreed that there would be no charge for the application to be made to Council.
Notably, the application was subsequently lodged with Council and changes were made to the detached
house that addressed neighbouring resident’s concerns.
