       The proposed development is consistent with the SPP.

       Planning Regulation 2017

       Under the State Assessment Referral Agency (SARA) mapping, the site fronts a state controlled
       road, with the landfill located on land within 25m of a State controlled road (refer Figure 6).

       Under Schedule 10 of the Planning Regulation 2017 (PR2017) the application requires referral
       to SARA, pursuant to Part, 9, Division 4, Table 4, Item 1 being within 25m of a State transport
       corridor. It is noted the application was originally referred to the Department of Main Roads
       (as a concurrence agency) under the current approval. A copy of the State Development
       Assessment Provisions for State Code 1: Development in a state-controlled road is provided
       as Appendix A.

       The subject land is also within the Koala Priority Area and the Core Koala Habitat Area in part
       and the Locally refined koala habitat area, in part (refer Figure 7, below).

       Under Schedule 10, part 10, Koala habitat in the SEQ Region, development is prohibited
       development where located within a koala priority area and koala habitat area, which is the
       case here, unless exempted development.

       Under the PR2017, exempted development includes at (d) development for infrastructure
       stated in Schedule 5 if the development is carried out by or for the State or a public sector
       entity. Under Schedule 5 – Infrastructure, includes at 16 – waste facilities. Consequently, the
       clearing of koala habitat for this purpose is not prohibited development.
