ORDINARY MEETING AGENDA 21 APRIL 2022 9. ORDINARY MEETING REPORTS 1 OPW21/0133 - FURTHER REPORT FOR OPERATIONAL WORK (PRESCRIBED TIDAL WORKS) AT 1O-12 RAVENWOOD DRIVE NOOSA HEADS Author Coordinator Engineering, Mark Lewis Environment & Sustainable Development Department Index ECM/ Application/ OPW21/0133 Attachments Nil EXECUTIVE SUMMARY The applicant seeks retrospective approval for a jetty constructed (contrary to the approval issued in 1994) at 10-12 Ravenwood Drive and the addition of a Jet Ski dry storage pontoon. The subject application follows on from compliance action (refer to COM20/0734) noting the following: “It has been brought to Council’s attention that a retaining wall and boat/jet ski lifting devices have been erected on State land without the appropriate approvals. It should also be noted that the Jetty is not complying with the approval as the walkway appears to be approximately 9 metres long contrary to the approved plans which indicates 6 metres.” This request raises concerns regarding adverse amenity impacts and potential conflicts with users of the neighbouring jetty and is not supported by the relevant provisions of the Noosa Plan 2020. Therefore, the application is recommended for refusal. The application was presented to the Planning and Committee Meeting on 12 April 2022 and to the General Committee Meeting on 19 April 2022 wherein council requested a further report with an alternative motion for approval for consideration. The application is recommended for refusal. RECOMMENDATION That Council note the report by the Development Engineer to the Planning & Environment Committee Meeting dated 21 April 2022 regarding OPW21/0133 application for Operational Works (Prescribed Tidal Works) at 10-12 Ravenwood Drive, Noosa Heads and: A. Refuse the application for the following reasons: 1. The proposal is contrary to PO1, PO9, PO13, and PO19 of the Waterways Works Code as it: 1.1 will lead to cluttering and adverse amenity impacts on the character and amenity of the waterway and adjoining lots; 1.2 includes works outside the prolongation of boundaries of the lot; 1.3 will result in berthed vessels encroaching over the prolongation of boundaries of the lot; 1.4 when all vessels are moored, prevents the jet skis from leaving its dry storage pontoon; 1.5 will result in adverse amenity impacts and potential conflicts with users of the neighbouring jetty and put at risk users’ safety. B. Advise the applicant that the jetty must be modified to comply with the approved plans of development. C. Note the report is provided in accordance with Section 63(5) of the Planning Act 2016.
