Ecological Assessment Report
3 - 7 Serenity Close, Noosa Heads
2.2 APPROVED DEVELOPMENT
The site has a history of approvals which extend from 2010 to the change to existing
approval which was granted in 2017.
2.2.1 LOCAL AND STATE APPROVALS
On the 8 April 2010, Sunshine Coast Regional Council issued a Development Permit for
Multiple Dwelling (109 Dwelling Units) and Accommodation Building (90 Accommodation
Units) and Ancillary Facilities (MCU 2008/276). An appeal was lodged with the
Environment Court and the Court subsequently issued a development approval on the 14
October 2011 (Planning and Environment Court Appeal 18 of 2010). The original
development application (MCU 2008/276, 8 April 2010) was assessed and approved
under the superseded Planning Scheme & Strategic Plan 1997, together with the
associated State referrals and codes which were applicable at the time the application was
originally made (13 March 2008) (Council Application Ref.: 132008.176).
On the 6 December 2013, the Planning and Environment Court approved a change to
condition 35 of the 2010 approval - extending the relevant period until 8 April 2017 and
included an additional condition (condition 106) for a monetary contribution of $44,160
for the offset of 48 koala habitat trees in accordance with the Policy for Offsets for Net
Gain of Koala Habitat in South East Queensland, which was current at that time. The offset
was subsequently paid by the applicant and was used for the planting and maintenance of
300 Koala habitat trees within the Girraween Nature Refuge.
On the 7 February 2017, Noosa Shire Council approved an existing approval to change
condition 35, extending the relevant period until 8 April 2021. The relevant period was
further extended for 12 months (until 8 April 2022) resulting from the extensions granted
by the Minister for Planning associated with the declared COVID-19 applicable event. A
further application to extend the currency period of the original approval was made in
2022. As such, the 2017 development approval remains current.
The 2017 change to existing approval (Council Application Ref.: 132008.176.03, 7 February
2017) is for a Resort Development comprising Multiple Dwelling (109 Dwelling Units) and
Accommodation Building (90 Accommodation Units) and Ancillary Facilities. An extract
from the approved plans is shown in Figure 3. The 2017 change to existing approval did
not change the State Government referral agency conditions from the original 2010
development approval, including those from:
● Department of Natural Resources and Water (DRW) (Ref.: IC0508NAM0002, 12 June
2008), and
● Department of Environment and Resource Management (DERM) (Ref.: 324907, 8
January 2010).
