ORDINARY MEETING AGENDA 16 JUNE 2022
Applicant’s position
Stockwell does not support this condition and it achieves a very negative design outcome for the
project. Planting trees from the basement will create a large open-air cavity (void) to the basement
which exposes the basement area to weather, flooding, rubbish, leaves, falling trees and branches
and fall risk and safety for children. In addition it has an overall impact on the building structure and
the cost of the building construction.
We believe the purpose of the inclusion of this condition was to increase deep planting in the space
between the buildings. This was previously addressed with the officers by increasing the space
between Buildings A and B and moving the buildings behind a 6m setback zone. It was agreed that
this outcome was acceptable, and we closed the matter.
The below exert from the site plan shows extensive deep planting already proposed for this space
with further support of shrubbery and lower planting behind to ensure the density is supported. This
is well in excess of the required 6 metre buffer as per the planning scheme.
Officer response
It is acknowledged that a significant landscaped area is located between the front boundary and the
area identified to provide deep planting. It is also acknowledged that modification to the design of
the basement to accommodate the basement may result in some additional cost to the developer.
Notwithstanding, the removal of 9 car spaces from within the basement provides the opportunity for
an iconic vegetated outcome which will significantly enhance the separation between buildings A
and B. The matters raised by the applicant with regards to safety can be overcome by the provision
of balustrading.
Condition 53
53. Prior to the prestart meeting, a bank guarantee or a bond of $30,000 must be lodged as
security for the protection of the tree/s identified for retention in the conditions of this approval.
