Outcomes of 2019 Delegations Review

New Delegations

The delegation review has identified that the following new delegation registers are applicable to
Council’s operations:

    Industrial Relations Act 2016;
    Land Title Act 1994;
    Peaceful Assembly Act 1992;
    Nature Conservation Act 1992; and
    Nature Conservation (Wildlife Management) Regulation 2006.

Copies of the complete new delegation registers to be delegated by Council are provided at
Attachment 1.

Required updates to current delegations
The delegation review has identified a number of required amendments to the current Council to
CEO delegations relating to the following Acts:
    Heavy Vehicle National Law (Qld);
    Local Government Act 2009;
    State Penalties Enforcement Act 1999;
    Waste Reduction and Recycling Regulation 2011;
    Work Health and Safety Act 2011;
    Work Health and Safety Regulation 2011.

The updated delegation registers relating to the above Acts are provided at Attachment 2. The
changes to the delegations are identified in tracked changes in the Attachment.

By having these delegations in place, official approval by Council is not required in the event that
the CEO or an appropriate on delegate is required to exercise the relevant power referred to in
the delegation.

Summary of current delegations not requiring changes
To avoid any doubt, the current Council Delegations of Authority listed below require no changes
to the previous year.
   Animal Management (Cats and Dogs) Act 2008;
   Asbestos (Public Health Act 2005);
   Biosecurity (Biosecurity Act 2014);
   Body Corporate & Community Management (Body Corporate and Community Management
     (Specified Two-lot Schemes Module) Regulation 2011;
   Building (Building Act 1975);
   Disaster Management (Disaster Management Act 2003);
   Environmental Offset (Environmental Offsets Act 2014);
   Environmental Protection (Environmental Protection (Water) Policy 2009, Environmental
     Protection Act 1994, Environmental Protection Regulation 2008);
   Fire and Rescue Services (Fire and Emergency Services Act 1990);
   Food Premises (Food Act 2006 and Food Production Safety Act 2000);
   Information Privacy (Information Privacy Act 2009);
   Integrity Act (Integrity Act 2009);
