PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 21 JULY 2015

A new specific outcome is to be added to the Natural Resource Code to specify “the Mary River
drinking water intake is not adversely affected by development or the effects of development”. A
new specific outcome requires that “Development in water supply buffer areas is undertaken in a
manner which contributes to maintaining and improving the water quality in those catchments”
and the applicable solution would be that “Development complies with the Seqwater
Development Guidelines: Development Guidelines for Water Quality Management in Drinking
Water Catchments”.

It has also been requested that the Lake Macdonald water treatment plant and the water pipeline
be mapped and protected. The following is to be inserted into the DEOs to protect bulk water
assets:

Existing and future bulk water infrastructure and corridors are protected from development that
would compromise the corridor integrity, and the efficient delivery and functioning of the
infrastructure. Bulk water supply infrastructure is protected from encroachment from sensitive
uses.

A new overall outcome is added to the natural resources overlay code at Section 13.42.2 to
ensure development in proximity to existing bulk water supply infrastructure and corridors does
not compromise the delivery and functioning of infrastructure nor lead to encroachment by
incompatible uses.

Additionally, a request has been made that camping in the water supply catchments or that at
least it be assessed and conditioned and therefore no self-assessable RV parking could occur in
the catchment areas. Applications for camping and RV parking in the water supply catchments
instead would be considered as code-assessable.

The State has requested that camping be set back no less than 400 metres from the upper flood
margin of Lake Macdonald, 100 metres from the bank of a permanent watercourse and 50m from
the bank of an intermittent water course where located in the water supply buffer area.

d) Biodiversity

The State has asked that Council clarify matters relating to environmental offsets. Specifically,
the State has asked that the planning scheme identify Matters of Local Environmental
Significance as separate from Matters of State Environmental Significance, or alternatively
remove references to environmental offsets throughout the Noosa Plan. This is to prevent any
confusion about which level of government is required to deliver environmental offsets.

Matters of Local Environmental Significance (MLES) are likely to be mapped in the new planning
scheme following comprehensive updates to Council’s biodiversity studies. In the meantime, the
mapping of MLES in the current scheme is not considered necessary based on the information
available. Instead, amendments have been made to the Biodiversity Overlay Code (and the
DEOs) to make it clear that environmental offsets are restricted to the State offset areas for koala
habitat. Additional koala offset areas will be investigated as part of the new scheme preparation.

To help protect biodiversity and ensure suitable replacement plantings are provided as part of
proposals involving clearing, the provision in the Biodiversity Overlay Code for ‘Replanting and
Replacement’ is proposed to be amended to read:

Vegetation removed is replaced with -
a)   plantings of equivalent area that replicate the floristic structure of the vegetation removed;
     or
b) where this is not possible due to the characteristics of the site and the development,
plantings twice the number of the removed trees and plants of local origin.
