3. ASSESSMENT
Condition 2
Approved Plans
2. Development undertaken in accordance with this approval must generally comply with the
approved plans of development. The approved plans are listed in the following table unless
otherwise amended by these conditions.
Plan No. Rev. Plan/Document Name Date
SK02-01 B Proposed Site Plan, prepared by Epoch Architecture 02/02/2017
SK02-02 B Proposed Floor Plan, prepared by Epoch Architecture 02/02/2017
SK02-03 B Elevations, prepared by Epoch Architecture 02/02/2017
Issue:
Update approved plans schedule to include new proposal plans.
Applicant’s Representation
The applicant submitted the original proposal plans with the intention to refurbish the existing
building in order to accommodate the new uses. The applicant has however become aware that
the existing building is not structurally sound having been infected by termites and contains a
large amount of asbestos. Consequently, it is necessary to rebuild the building on the land.
The proposed building will have generally the same size, be positioned in a similar location and
maintain the same scale, bulk and appearance. The applicant therefore requests that condition 2
be updated to reflect the new proposal plans.
A copy of the approved development and latest proposal plans are provided in Attachments 1
and 2.
Assessment:
The original Material Change of Use to permit Retail Business Type 6 – Hardware and Retail
Business Type 7 – Garden Centre was recommended for approval based on the following
grounds:
1. The land enjoys existing use rights for various uses including some industrial uses with the
potential to generate off site impacts. The proposed development seeks approval for a
reduced range of uses able to operate from the site which are considered more compatible
in the area; and
2. The development offers various improvements to the site and provides an improved
interface between adjoining residential uses. The proposed building renovations and
landscaping outcomes collectively improve the visual amenity of the site and are
considered an overall community benefit.
Furthermore, a key consideration when assessing the original application related to the reuse of
the existing buildings on site. The applicant was advised by officers at the time of the original
application that they would be unlikely to support the proposal if the intention wasn’t to reuse the
existing commercial building. This is due to the expectation that when land is redeveloped, the
land should be developed consistent with the zoning intent for the site at the time and in this
instance for Attached Housing. The applicant now seeks approval to amend condition 2, which
would effectively allow the existing commercial building to be demolished and another rebuilt
which undermines the justification to support the original application.
