PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 8 MAY 2018
Notwithstanding this, the scale and bulk of the proposed building is in keeping with the existing
buildings on the land and does not raise any additional or increase the severity of known
impacts. The proposed change is limited to the alignment of the commercial building to Noosa
Eumundi Road, landscaped setbacks and a minor adjustment of the internal driveway and 3 car
parking spaces. The approved outdoor use area is also proposed to be reduced from 462m2 to
436m2. The proposed new building also offers an improved presentation to Eumundi Noosa
Road and has been generally designed to meet the Noosa Plan design requirements for
buildings in the area.
On this basis while the redevelopment is not entirely consistent with the grounds for support of
the original application, the new building plans are generally in accordance with the approved
plans of development as detailed in condition 2.
However, pursuant to the Sustainable Planning Act 2009 Council is not able to amend condition
2 of the approval as the Act does not permit applicant’s to change their application after a
decision has been made. It is therefore recommended that:
Condition 2 remain unchanged; and
Council acknowledges that the new proposal plans are generally in accordance with the
approved plans of development.
Condition 7
Water & Sewer Connections
7. A Certificate of Completion from the Northern SEQ Distributor–Retailer Authority
(Unitywater) must be submitted to Council that certifies an underground connection to
reticulated water and sewerage has been provided to the development site.
Issue:
Request to delete condition 3.
Applicant’s Representation:
The applicant accepts that this is a standard condition normally imposed on all development
approvals; however, in this case the land has been used for a similar development for many
years and is already connected to water supply and sewerage infrastructure. No boundary
changes are being proposed and it is therefore unnecessary to require the applicant to provide a
Certificate of Completion from Unitywater for development over an existing serviced parcel of
land. The land does not require any alteration to existing services.
Assessment:
The land has been developed and is currently connected to reticulated water and sewer. The
imposed condition is standard and is more relevant to new developments or newly created lots
where a service connections have not been provided.
It is therefore recommended that the condition be deleted.
