PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 19 AUGUST 2014
4. ASSESSMENT
Details and assessment of the requested changes to the existing conditions are provided below.
Conditions 10 & 11 – House Site Areas
10. Prior to endorsement of the plan of survey by Council, a metes and bounds plan shall be
submitted to Council indicating the house site and effluent disposal area/s on Lot 1 and Lot
2. The house site and effluent disposal area shall be located on areas outside the Coastal
Management District, Remnant Vegetation and a 40m buffer from the Remnant Vegetation
as identified by the Department of Environment and Resource Management (DERM)
reference IC0706NAM0013 and DERM-Ecoaccess Permit number: IPCC01443109.
11. There shall be no buildings, structures or civil works (eg earthworks, dams, levies,
driveways) within the Coastal Management District, Remnant Vegetation and the 40m
buffer from the Remnant Vegetation as identified by the Department of Environment and
Resource Management (DERM) reference IC0706NAM0013 and DERM -Ecoaccess
Permit number: IPCC01443109 or any environmental covenant created on this site.
Applicant’s Request
The applicant seeks deletion of the conditions due to their conflict with MCU11/0204 for a
dwelling which was approved by Council, issued after the subdivision approval and permits a
dwelling within the Remnant Vegetation. The condition is therefore inconsistent with the later
approval and should be deleted.
Assessment
It is agreed that the conditions conflict with the subsequently issued Material Change of Use
approval for a house on the site. The conditions were also generally redundant at the time of
issue because they reference concurrence agency conditions that apply to the approval. The
State and Assessment Referral Agency (SARA) has now amended its conditions through this
application process and removed these requirements.
Condition 11 can be deleted and it is recommended that condition 10 be simplified to read as
follows:
10. Prior to endorsement of the plan of survey by Council, a metes and bounds plan shall be
submitted to Council indicating the house site and effluent disposal area/s on Lot 1 and Lot
2.
Condition 13 – Rehabilitation of Coastal Management District
13. Prior to any works commencing on the site, an Operational Works (Landscaping)
application is required, and is to be approved by Council. The plan is for the Vegetation
Management and Rehabilitation of the Coastal Management District. The rehabilitation plan
shall include the following:
13.1 A revegetation layout on A3 plans at a scale of no greater than 1:500, including a
scale on the plan;
13.2 A species palette incorporating the species selection of only native indigenous
species;
13.3 Maintained free of grazing animals using appropriate fauna friendly fencing;
13.4 The removal of barbed wire from all fences within or on the boundary of the covenant;
13.5 Peg the boundary of the covenant area with durable posts at least every 10m with A4
signs stating “Covenant Boundary, Coastal Management District Area”
