PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 19 AUGUST 2014
13.6 All Class 1, Class 2 and Class 3 pest plants declared under the Land Protection (Pest
and Stock Route Management) Act 2002 and including all Camphor Laurel trees on
the property are to be controlled on the site prior to Council endorsement of the Plan
of Survey. In this context “controlled” shall mean, for class 1 and 2 pests, completely
eradicated. For class 3 pests it shall mean removal of the plants where they threaten
environmentally significant areas of the site such as riparian zones and areas of
natural vegetation.
Where class 3 plants are removed as a result of this condition and there is not
sufficient natural regeneration of native species, the areas shall be replanted with
endemic native species so that a sustainable natural ecosystem is restored.
Council’s Environment and Landscaping Unit will not inspect the site until 30 days
after the weed treatment and replanting is complete
13.7 Near to equal numbers of appropriate species to be used within the relevant
revegetation areas of the buffer so that one species of plant is not over or under
represented on the site;
13.8 The species densities of at least:
Sedges, macrophytes and grasses at 0.5 metres centres;
Shrubs at 1.5 metre centres; and
Trees at 1.5 metre centres for those species four metres from the boundary of
rehabilitation works for weed exclusion purposes and 2 metre centres for species
further from the edge;
13.9 Measurable and achievable criteria on which the performance of the floristic and
structural component of the re-vegetation strategy can be assessed annually over
three years, including no weeds on the entire covenant area for all of the 3 years and
at the end of the re-vegetation period; and
13.10 Nominate a total bond amount of 1.5 times the schedule of works estimate of costs
(plus GST) for the re-vegetation works, including maintenance for three years. This
plan must also nominate triggers for the release of this bond at 10% for the first year,
10% for the second year, and 80% in the final year.
Applicant’s Request
The applicant requests deletion of the requirement as the Coastal Management District of the site
is in good condition and does not need any revegetation or rehabilitation. The area is currently
fenced and is in its natural state and there is no need for any further works. The condition is
therefore superfluous, not relevant and should be deleted.
Assessment
The applicant’s submission regarding this area is generally agreed with. The Coastal
Management District Area is low-lying land (predominantly salt marsh) subject to tidal inundation.
Extensive landscaping works are not considered a reasonable imposition for a 1 into 2 lot
subdivision, particularly since no new property boundaries are proposed through the area.
Condition 29
29. Refer to the Department of Environment and Resource Management conditions in their
letter dated 10 February 2010.
Applicant’s Request
The condition is requested to be modified in accordance with anticipated changes from the
relevant referral agencies.
