3. Implications for Council
Under the Environment Protection & Biodiversity Conservation Act (Cth) (EPBC Act), approval
must be obtained from the Commonwealth Minister for the Environment before any action takes
place that could have a significant impact on the National Heritage values of a listed place. Under
the EPBC a significant action is where a National Heritage value could be lost, diminished or
destroyed. Council, or developers, need to refer any actions that are likely to have a significant
impact on the proposed Cooloola National Heritage Place to the Commonwealth. Examples of
significant actions include:
Modification to a dune system for vehicle access
Dredging of rivers and lakes
Coastal engineering works and structures
Roads or drainage construction through a rainforest
Clearing of coastal dune vegetation
A new campground or eco-tourism development
A proposed phone tower
A new commercial tourism venture
A major upgrade of the Noosa North Shore Beachfront Campground
A floating restaurant on a lake
Water extraction
Sand mining
A new utility such as a power line or water infrastructure
Developments that impact on the scenic landscape qualities of the Noosa River, sand dunes,
forests and wetlands
Widening of a road that impacts on endangered plant species or ecological communities
Under the EPBC Act, National Heritage Places are a Matter of National Environment Significance
(MNES). The Australian Government provides guidelines and information on the referral,
assessment and approval process for actions that may impact on a MNES.
