PROJECT URBAN – 20178 August 2020
6.5 DEVELOPMENT CODES
In accordance with table 5.6.1 the following Codes are applicable to the proposed development:
• Rural Zone Code
• Reconfiguring a Lot Code
• Works Codes
Comment: An assessment of the applicable codes has been included within Attachment 1.
The code assessment has determined that the proposed development complies with all relevant
performance outcomes. Where compliance with the acceptable outcomes has not been met,
alternative solutions addressing compliance with performance outcomes has been undertaken
section 6.5.1.
6.5.1 ALTERNATIVE SOLUTIONS
Reconfiguring a Lot Code
Acceptable Outcome 7.9
As stated under AO7.9, it is required that the existing ecological land located on site be protected
via a covenant or transfer of land. For the purpose of this proposal, it is not considered necessary
to establish a covenant on the following grounds:
• The proposal does not require any clearing for the establishment of the new lot boundary;
• Sufficient land is left unaffected by environmental constraint, minimising the need for land
clearing;
• The proposal does not increase the population of the subject site;
• All existing scenic amenity of the site and area is not impacted upon.
This is determined to demonstrate that the proposal is a site responsive design, in accordance
with the requirements of PO7. It is therefore not considered to be necessary to establish a
covenant on the subject site.
Acceptable Outcome 26
The proposed boundary realignment does not result in an improvement to the compliance of the
subject lots regarding the minimum lot size. On this basis, the proposal is not able to achieve
compliance with AO26.
In accordance with PO26, it is required that:
Development provides that the rearrangement of lot boundaries is an improvement on the
existing situation.
As specified in the proposal description, the purpose of the boundary realignment is to enable
the driveway currently servicing Lot 1 to be wholly located within the subject allotment. It is
considered that this would improve the existing access arrangement on the following grounds:
• It would protect the access to Lot 1 for the life of the dwelling house;
• Ensures that vehicles accessing Lot 1 are fully confined within Lot 1;
• It would prevent disputes regarding maintenance of the driveway;
