result in a substantially different development. Section 82 (4) of the Planning Act 2016 prescribes
the matters for assessing and deciding the change application in the context of the existing
development approval.
The following assessment considers the applicable matters in the context of an existing approval for
a Restaurant, Shop & Professional Office, and the change to incorporate dual occupancy.
The application also includes a change to a dual occupancy to afford the right for the premises to be
used for permanent residential accommodation at any time.

provide a wide range of predominantly commercial, retail and community activities with supporting
residential to provide for the needs of visitors, residents and local employment. Retail uses are
focused along Poinciana Avenue, with shop fronts activating the streetscape.
Mixed used residential developments are encouraged within the District Centre Zone, providing for
affordable housing opportunities close to shops and services. The development provides for the
needs of visitors and residents, offering mixed-use retail, commercial and residential uses, consistent
with the relevant overall outcomes of the local plan code.
An assessment against each of the relevant performance and acceptable outcomes demonstrates
compliance with the code and is included in Appendix 1.
4.3 District Centre Zone Code
The Overall Outcomes of the District Centre Zone seek for development to provide a mix and range
of goods and services, employment, residential and retail uses to service the needs of the local
community and its visitors. Development within this zone contributes to the vibrancy and economic
activity of the centre.
Residential uses including dual occupancies are a consistent use within the District Centre Zone in

appropriate to the centre role and function of the area. The development's mixed used formation is
consistent with the relevant overall outcomes of the District Centre Code.
An assessment against each of the relevant performance and acceptable outcomes are included in
Appendix 2. with further comment provided below.
