PO41
Mixed-use buildings are designed and operated to ensure:
a) business uses manage potential impact on residents, including impacts associated with:
(i) visual and acoustic privacy;
(ii) safety and security; and
(iii) Lighting.
b) residential uses do not limit the business opportunities of the site; and
c) residential uses have reasonable privacy, security and private outdoor living space
AO41.4
Dwellings provide:
a) clearly identify private residential space by using features such as low walls, changes in surface
texture or other landscape treatments.; and
b) private open space or an open balcony directly accessible from a habitable room:
(a) with a minimum area of 9m²,
(b) with a minimum dimension of 2.5 metres; and
(c) clear of any utilities such as gas, water tanks and air conditioning units.
Although the development does not meet the Acceptable Outcome – AO41.4 for 2.5m minimum
width of balconies (provided 2m as shown below), the existing balcony is 12m2 and provides
sufficient private outdoor living space for the residents. The proposed re-use of the upstairs tenancy
does not limit the business opportunities on ground level - consistent with the Performance Outcome
PO41.
