It is relevant to note the Cooroy Local Plan Code Performance Outcome PO17 seeks that where
a development is undertaken on a property with a laneway frontage and access is not taken, a 2m
wide easement for a public thoroughfare is provided for future widening or upgrading purposes. In
this instance the development is not taking access from Diamond Lane and has provided a 2m
wide landscaping strip which excludes a 0.5m bioswale along Diamond Lane suitable for an
easement. A condition is recommended to provide a public thoroughfare easement in accordance
with the planning scheme.
5. CONSULTATION
5.1. Referral Agencies
The application was referred to the following Referral Agencies:
Department of Infrastructure, Local Government and Planning (SARA)
The Department is a referral agency as the lots have frontage to a State Controlled Road.
The Department has responded advising the development raises no concerns and have provided
conditions requiring a median strip and a left in left out access.
It should be noted the site is contaminated land and on the Environmental Management Register
(EMR) as it was previously an Energex depot. This application was not required to be referred to
the State as a Concurrence Agency, but the applicant is required to gain a separate approval from
the State.
5.2. Other Referrals
The application was reviewed by the following external consultants for Council:
Architecture
NRA Collaborative - nra-co-lab – Noel Robinson/Peter Cain
Traffic
Holland Traffic Consulting – Stuart Holland
