Attachment A
Decision Evidence and Findings
Findings on material questions of fact:
The objective of the Transport Infrastructure Act (1994), (TIA) requires the establishment
of a road regime that is safe and efficient.
Section 62 of the TIA provides for the Chief Executive of the Department of Transport
and Main Roads to make decisions about permitted road access locations between
particular land and a state-controlled road.
The development is a reconfiguration of a lot (1 lot into 2 lots) and an access easement.
The subject site has an existing access to McKinnon Drive and no change is proposed to
the access. Access to that state-controlled road is obtained vis existing easement C on
SP199340 and an easement is required to access proposed Lot 2. The new easement
will burden proposed Lot 1 and benefit proposed Lot 2.
The subject site does not have a current decision under section 62A of TIA.
McKinnon Drive is a single lane in each direction with a broken double centre line to
allow access to the subject site. There is a westbound CHR for the intersection with
Silverwood Drive (a local road) approximately 16m west of the subject site access point
to the state-controlled road. The road has a wide shoulder in each direction. The annual
average daily traffic is 3168 vehicles (2023) and a posted speed limit of 100km/hr.
McKinnon Drive is not covered by a limited access policy at the subject site.
