                        Dear Sir,

                        Re:     Application for a Change to a Development Approval for Multiple Dwellings - 3
                                Units (3 spa pools) situated at 61 Noosa Parade, Noosa Heads described as Lot 1-
                                3 on GTP 472

                        I refer to your request to make a change to the above development approval. On 19
                        November 2004 Council decided to: -

                        A.      Approve the plans titled Location of Spas - Exclusive use Areas on GTP472 County
                                March Parish Weyba Sketch Plan "A", prepared by D.R. Redman and dated 29.9.04.

                        B.      Include additional conditions to read as follows:-
                                 1.    Development undertaken in accordance with this approval must generally
                                       comply with the approved plans of development. The approved plans are titled
                                       Location of Spas - Exclusive use Areas on GTP472 County March Parish
                                       Weyba Sketch Plan "A" dated 29.9.04 and prepared by by D.R. Redman and as
                                       may be amended by these conditions.
                                2.     Unit 2 gate to Noosa Parade is to be permanently secured shut at all times.
                                3.     Swimming pool or spa pumps are to be contained in an acoustically treated
                                       enclosure or located in a manner which prevents a noise nuisance beyond the
                                       subject land in accordance with the nuisance provisions of the Environmental
                                       Protection Regulation 1998. On the spot fines apply for such offences.

                        You are entitled to appeal against this decision. A copy of the relevant appeal provisions
                        from the Integrated Planning Act is also attached.

                        Should you wish to obtain more information about Council's decision, the reports and staff
                        recommendations regarding this application are available for viewing or purchase at the
                        Level 2 counter of Council offices. It would assist Council staff if you could bring this letter
                        with you.
