2. BACKGROUND
The original Development Approval for an Industrial Business – Type 2 and associated Operational
Works was granted on 2 March 2018, with a Negotiated Decision Notice subsequently issued on
20 April 2018 (MCU17/0568).
The approved development comprised a total Gross Floor Area (GFA) of 1,992m² and required the
provision of 27 car parking spaces and 6 bicycle parking spaces.
On 5 October 2023, Council approved a Minor Change application to the Development Approval
(MCU17/0568.01), which included:
• Retrospective approval for building extensions established at the rear of the premises,
comprising a beam shop, storage shed, and additional drying shed, with a combined area of
366m²; and
• A display eco-cottage area located within the north-western corner of the site adjacent to the
Jarrah Street frontage
3. ASSESSMENT
3.1. Instruments for Statutory Assessment
Under the Planning Act 2016 the application must be assessed against each of the following
statutory planning instruments to the extent they are relevant to the development:
• State Planning Policy;
• South East Queensland Regional Plan;
• Planning Regulation 2017; and
• Noosa Plan 2020 (Amendment 3 - 20 March 2026).
3.2. Statutory Process
The applicant has requested to make a minor change to a development approval under s78 of the
Planning Act 2016. An application for a minor change to a development approval can only be made
in circumstances where a change would constitute a ‘minor change’.
The proposed change to the development approval requested by the applicant is determined to
constitute a minor change on the grounds that:
• the development would not result in substantially different development as the proposal does
not:
o involve a new use; or
o result in the application applying to a new parcel of land; or
o dramatically change the built form in terms of scale, bulk and appearance; or
Page 4 of 9
Document Set ID: 24936711
Version: 4, Version Date: 29/07/2026
Page 5
o change the ability of the proposed development to operate as intended; or
o remove a component that is integral to the operation of the development; or
o significantly impact on traffic flow and the transport network, such as increasing traffic
to the site; or
o introduce new impacts or increase the severity of known impacts; or
o remove an incentive or offset component that would have balanced a negative impact
of the development; or
o impact on infrastructure provisions.
• the change does not include prohibited development.
• the change would not require the application to be referred to an additional referral agency or
cause a referral agency to have regard to new matters prescribed by regulation.
• where the original application was code assessable, the change would not cause the
application to become impact assessable.
3.3. Statutory Instruments – Planning Scheme
In assessing the application, Council must consider the planning scheme in effect when the
development application was made (Noosa Plan 2006) but also give weight to the planning
scheme when the change application was made (Noosa Plan 2020).
The following codes from the Noosa Plan 2020 are applicable to this development:
• Medium Impact Industry Zone Code;
• Cooroy Local Plan Code;
• Industry Activities Code;
• Works Codes;
• Bushfire Hazard Overlay Code.
The proposed changes have been assessed against the above codes and the pertinent matters
arising out of the assessment are outlined and discussed below:

relevant:

used as an office.
84. The rear access as proposed on Site Plan – Landscape Added, drawn by Eco Cottages
dated 19 June 2023 is not approved. No vehicular access is to be gained from the rear

85. The proposed works (pedestrian foot bridge, showroom) must not adversely affect the
treatment capabilities or the structural integrity of any component of the existing
bioretention basin.
86. The supervising RPEQ must certify that the proposed works (pedestrian foot bridge,
showroom) has not adversely affected the treatment capabilities and structural integrity
of the existing bioretention basin. Certification must be provided and accepted by
Council at the completion of the works.

Page 8
Assessment of Request
As indicated in the table above, the revised parking provision of 15 spaces (including 1
disables space) complies with both the current as superseded planning schemes.
Recommendation
It is recommended existing MCU condition 16. be amended to read as follows:
16. A minimum of 15 car spaces, including 1 disabled space must be provided on
site, in accordance with the approved plans
4. Bicycle and End of Trip Facilities
In terms of bicycle parking, lockers and shower cubicles the following condition was included
on the previous minor change approval:
17. a minimum of 9 bicycle parking spaces, 2 lockers and 1 shower cubicle must be
provided on site.
The current application reduces the GFA of the development to 708m2. Based on Table
9.4.1.4 - Minimum parking requirements including end of trip facilities the bicycle parking
requirements are:
• 1 space/100m2 GFA up to 500m2; and
• 1 space/500m2 GFA above 500m2.
Therefore, based on the GFA 6 bicycle spaces are required.
The plans provided for this minor change do not indicate the provision of end-of-trip facilities.
Therefore, this condition will be retained as follows but the requirement reduced to reflect the
smaller GFA.
Recommendation
It is recommended existing condition 17. be amended to read as follows:
17. a minimum of 6 bicycle parking spaces, 2 lockers and 1 shower cubicle must
be provided on site.
