MAYORAL MINUTE
I hereby give notice of my intention to move the following motion at the Ordinary Meeting on
Thursday, 18 October 2018:
1 PROPOSED SETTLEMENT OF PLANNING & ENVIRONMENT COURT APPEAL 4066 OF
2017 - 215 DAVID LOW WAY, PEREGIAN BEACH
That Council:
A. Agree to settle Planning & Environment Court Appeal 4066 of 2017 for a Material Change
of Use and Reconfiguring a Lot currently before the Court for 215 David Low Way,
Peregian Beach subject to the terms and conditions as set out in Attachment 2 of this
Mayoral Minute; and
B. Note that a further report will be presented to a future Council meeting for Council’s
consideration detailing a full set of development conditions for the proposed development
and seeking Council’s agreement to finalise the appeal.
BACKGROUND
At the Ordinary Meeting of 21 December 2017 Council considered a report on an appeal in respect
of a mixed use residential development at 215 David Low Way, Peregian Beach, comprising 26
multiple dwelling units (permanent occupation), 20 visitor motel units and 12 units that could be either
multiple dwelling units or visitor units. At this meeting Council resolved to defend the appeal.
Since that time the appeal has progressed in accordance with the Planning & Environment Court
directions, including 2 mediations held with the court register but with no agreement by the applicant
to reconsider their proposal pans. In late May just prior to the trial commencing, the applicant
changed their application reducing the number of proposed units (by 6 units) to:
32 visitor motel units
20 multiple dwelling units
The applicant also amended the proposal plans by removing the dual key units, reducing the size of
the motel units, increasing the open space area and setbacks to all boundaries and reducing car
park numbers to reflect the lower parking rate for motels. These plans also identified an emergency
evacuation route from the site to Rufous Street. These amended plans are included as Attachment
1. While these plans offered an improved overall site layout, the proposed changes did not address
the principle conflict with the Noosa Plan with 20 multiple dwelling units still proposed for permanent
residency, eroding the visitor accommodation opportunities sought by The Noosa Plan for the site.
The trial was not finalised in May 2018 due to these last minute changes to the application and also
because of the number of experts involved for the applicant, submitter and Council. Accordingly,
further time for the trial was set down by the court for a week commencing 15 October 2018 to allow
all experts to present their evidence and final summations to be given by all parties to the court.

Section 2
During the course of this week, the applicant proposed a settlement offer to the submitter and
Council. The proposed settlement proposes to make a further change to the application to the court
such that:
1. The 20 multiple dwelling units will be now for short term visitor accommodation only (20 visitor
units)
2. The site will be reconfigured into 3 separate lots containing:
The IGA based supermarket development
The motel component of the proposed development
The land containing the 20 visitor units
3. The 20 visitor units will be subject to a community title scheme building format plan with these
being defined by each visitor unit building footprint and the balance area being in common
property. An exclusive use area (for a courtyard) over the common property will be provided
for each visitor unit.
4. The motel component may be subject also to a community title scheme building format plan.
5. The approval will be subject to a condition that the roof of the motel building be lowered.
6. With respect the northern boundary of the land adjacent to Rufous St reserve and Rufous
Lane:
The development setback will be increased to 3m and landscaped.
The visitor units will be relocated to essentially move the ‘pocket park’ shown on the
proposal plans to be adjacent the Rufous St road reserve area.
Rufous St reserve will be landscaped
7. The area along the western boundary of the IGA within the development site will be
landscaped.
8. The emergency evacuation route for motor vehicles will be moved to between the western
boundary of the IGA shopping centre site and the edge of the landscaping strip along the
eastern side of the motel.
9. A detailed emergency and evacuation plan will be prepared by the applicant.
10. The visitor units will be subject to a condition which allows the continuous occupation of each
unit for up to 90 days each calendar year, with a register of occupation to be kept by the
relevant body corporate and made available to Council upon request.
These terms and conditions of the settlement offer are set out in Attachment 2.
The proposed settlement offer is a significant win for the community and will secure the site for 32
motel units and 20 visitor units consistent with the Noosa Plan’s strategic intent for the site to support
the tourism industry and provide for a range of visitor accommodation choices in Noosa. It also
removes the previously proposed accommodation for permanent residents from the site and the
potential for conflict between different users on site. The changes have also prompted a redesign,
reducing the overall number of units on site, enhancing landscaping opportunities, and also
improving setbacks and the development’s interface with surrounding properties. Additional and
appropriate bushfire management, stormwater management and acoustic measures will also form
part of the final conditions of the development.
In view of these significant changes which have brought the development into substantial compliance
with The Noosa Plan, Council should resolve to settle the appeal on the basis of the proposed
settlement negotiated by Council’s appeal team.

and conditions:
l, The Appellant will make an application to the Court for a minor change in the application such
that:

(i) the IGA based supermarket development;
(ii) | the motel component of the proposed development; and |
(iii) the land containing the twenty (20) dwelling units; |
subject to an appropriate plan of reconfiguration submitted to and approved by the |
Council; |
| (c) The Visitor Accommodation — Type 4 development (ie the dwelling units) component
will be subject to a community title scheme building format plan with:

|Section 11
|
(iii) the curtilage of each of the particular dwelling units being allocated to that

2. The agreement is subject to the minor change application referred to in paragraph 1 being
approved by the Court.
3. The motel component, if it is to be further subdivided, will be subject to a community title
scheme building format plan
4. The approval will be subject to a condition that the roof of the motel building be modified
generally in accordance with the design and the height of the roof form depicted in Exhibit 1,
p.31, namely Drawing No.16003SD21 Revision C dated 28 March 2017.
5. With respect to the northern boundary of the land (adjacent to the Rufous Street reserve and |

nearest point of any of the dwelling units along the northern boundary; |
(b) the setback to the eastern boundary of the unit numbered 16 shall be reduced to 4m and |
the distance of 3.7m will be used to widen the pedestrian link (presently 3.0m) between |
proposed Units 13 and 14 to the Rufous Street precinct to 6.7m with necessary relocation |
of dwelling units along this boundary; |
(c) the 3m setback referred to in (a) above and the 6.7m pedestrian link between proposed

along the eastern side of the motel generally in accordance with the plan attached
as Annexure A;
(ii) | widen the crossover to Sandpiper Court to facilitate emergency vehicle access; |
(b) the Appellant will provide a detailed emergency and evacuation plan to the satisfaction
of the Council, which will include a requirement that in the event of a bushfire, the Motel
carpark will be locked, preventing guests from evacuating by vehicle.
8. The Visitor Accommodation Type 4 dwelling units will be subject to a condition which allows
the continuous occupation of each of such units for up to 90 days each calendar year, with a
register of occupation to be kept by the relevant body corporate and made available to the |
