During the course of this week, the applicant proposed a settlement offer to the submitter and
Council. The proposed settlement proposes to make a further change to the application to the court
such that:
1. The 20 multiple dwelling units will be now for short term visitor accommodation only (20 visitor
      units)
2. The site will be reconfigured into 3 separate lots containing:
 The IGA based supermarket development
 The motel component of the proposed development
 The land containing the 20 visitor units
3. The 20 visitor units will be subject to a community title scheme building format plan with these
being defined by each visitor unit building footprint and the balance area being in common
property. An exclusive use area (for a courtyard) over the common property will be provided
      for each visitor unit.
4. The motel component may be subject also to a community title scheme building format plan.
5. The approval will be subject to a condition that the roof of the motel building be lowered.
6. With respect the northern boundary of the land adjacent to Rufous St reserve and Rufous
      Lane:
 The development setback will be increased to 3m and landscaped.
 The visitor units will be relocated to essentially move the ‘pocket park’ shown on the
proposal plans to be adjacent the Rufous St road reserve area.
 Rufous St reserve will be landscaped
7. The area along the western boundary of the IGA within the development site will be
      landscaped.
8. The emergency evacuation route for motor vehicles will be moved to between the western
boundary of the IGA shopping centre site and the edge of the landscaping strip along the
      eastern side of the motel.
9. A detailed emergency and evacuation plan will be prepared by the applicant.
10. The visitor units will be subject to a condition which allows the continuous occupation of each
unit for up to 90 days each calendar year, with a register of occupation to be kept by the
relevant body corporate and made available to Council upon request.
These terms and conditions of the settlement offer are set out in Attachment 2.

The proposed settlement offer is a significant win for the community and will secure the site for 32
motel units and 20 visitor units consistent with the Noosa Plan’s strategic intent for the site to support
the tourism industry and provide for a range of visitor accommodation choices in Noosa. It also
removes the previously proposed accommodation for permanent residents from the site and the
potential for conflict between different users on site. The changes have also prompted a redesign,
reducing the overall number of units on site, enhancing landscaping opportunities, and also
improving setbacks and the development’s interface with surrounding properties. Additional and
appropriate bushfire management, stormwater management and acoustic measures will also form
part of the final conditions of the development.

In view of these significant changes which have brought the development into substantial compliance
with The Noosa Plan, Council should resolve to settle the appeal on the basis of the proposed
settlement negotiated by Council’s appeal team.
