There have been two subsequent development permits for material change of use over the land that
have provided for the construction of the ‘Eco-Cabins’. The first development approval (Attachment
1A) was granted on 23 March 2006 for Stage 1 and was subsequently changed on the 15 September
2010 and again on 18 June 2012. This remains the current development approval for Stage 1 of the
development being for 24 Eco-Cabins (1-24) and ancillary facilities and a development permit to
reconfigure the land into 4 allotments. The Eco-Cabins were constructed within there own
allotments being Lots 1 to 24, with the approval also providing for the Village Green Recreational
Centre. Importantly, condition 6 of the approval states:

The Eco-Cabins shall be for short term visitor accommodation only, with no person permitted to
occupy the Eco-cabins for the purposes of permanent accommodation in accordance with the Noosa
North Shore Eco-Tourism Portal Development Code.

The second development approval for Stage 2B provides a development permit for another 24 Eco-
Cabins on the land (Attachment 1B). This development approval provides for Eco-Cabins to be
constructed on Lots 25 to 48, inclusive. It is important to note that condition 6 of the second
approval states:

The Eco-cabins shall be for short term visitor accommodation only, with no person permitted to occupy
the Eco-cabins for the purposes of permanent accommodation in accordance with the Noosa North
Shore Eco-Tourism Portal Development Code.

Another development approval for Stage 3B was obtained on 24 May 2012, which provided a
further development permit for material change of use for an additional 24 ‘Eco-Cabins’. However,
