PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 28 APRIL 2015
Proposed Amended Subordinate Local Law No 2 (Animal Management) 2015
The proposed Amended Subordinate Local Law No 2 (Animal Management) 2015 as
provided in Attachment 2 reflects the recommended amendments outlined above to the
proposed subordinate local law resulting from community consultation.
Proposed Subordinate Local Law No 3 (Community and Environment Management)
2015
One submission was received in support of the proposed subordinate local law outlining that
the provisions to further regulate smoke and fires was an excellent move to protect the
health and wellbeing of residents. It is recommended that no amendments be made to the
proposed subordinate local law.
Proposed Subordinate Local Law No 4 (Local Government Controlled Areas, Facilities
and Roads) 2015
One submission was received relating to advertising devices recommending that bunting
and LED lit signage not be prohibited on local government controlled land or land where they
can be viewed from a local government controlled area as provided in the proposed
subordinate local law.
Whilst the submission received has been carefully considered, it is recommended that no
amendments are made to the proposed subordinate local law as it is aligned to the
Advertising Devices Codes in the current Noosa Town Plan, which reflects the intention of
Council to protect the “look and feel” of Noosa.
Proposed Subordinate Local Law No 5 (Parking) 2015
No submissions were received relating to this proposed subordinate local law. Accordingly,
no amendments are suggested to the proposed subordinate local law.
Proposed Subordinate Local Law No 6 (Bathing Reserves) 2015
One submission was received relating to this proposed subordinate local law recommending
that the use of leg ropes on surfboards be made compulsory. This submission has been
considered, and whilst it is noted that it has merit in terms its intent to promote public safety,
the practicalities of enforcing such a provision are incredibly difficult.
As noted earlier in the report, it is recommended that the proposed subordinate local law be
amended following the public consultation and that the bathing reserve at Peregian Beach
be reduced at the southern end to commence at beach access 59 as opposed to beach
access 60. This will remove the inconsistency between the dog on leash area in subordinate
local law No 2 (Animal Management) which prohibits dogs within a bathing reserve and the
bathing reserve at Peregian Beach.
3. Anti-competitive provisions assessment
In accordance with the Approved Local Law Making Process (provided at Attachment 5), any
anti-competitive provisions in the proposed local laws and proposed subordinate local laws
must be identified and appropriately assessed.
Pursuant to section 38 of the Local Government Act 2009 (LGA), a local government must
not make a local law that contains an anti-competitive provision unless the local government
has complied with the procedures prescribed under the Local Government Regulation 2012
(LGR). The importance of ensuring that this process is considered carefully is that a local
law, which is made contrary to this section, has no effect.
