PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 28 APRIL 2015

In response to the theatre’s concerns, the applicant is also willing to accept a condition
restricting the hours of any tenant to daytime hours (7am to 6pm), to further avoid conflicts
with the majority of the theatre show times, which occur during the evenings.
Having regard to the permitted uses on the site, imposing conditions on noise levels and
time of use will reasonably mitigate additional adverse noise impacts on the adjacent
heritage theatre.
Light and air flow impacts
The Pomona Arts Society has expressed concerns the proposed nil setbacks to the western
boundary will result in adverse impacts to light and ventilation (opening windows and
changes to the air movement around the traditional stilt and vent cap designed building).
In response to the theatre’s concerns, the applicant has expressed willingness to further set
the proposed building extensions 1m from the boundary near the theatre’s eastern facade.
This will ensure a 2m overall setback between the buildings.
Increasing the building setback to the theatre will allow for the opening of existing windows,
and increase the air flow and landscaping between buildings. Conditions may also be
imposed for the new uses to not unreasonably interfere with the existing theatre from the
operation of machinery or the like.
Frontage Works and Access
The current frontage works are degraded and incomplete, with some elements of the current
use (garden beds and pavement) located beyond the boundary in the road reserve. Both
Factory Street and Hill Street are State controlled roads and the concurrence agency
response requires the site’s frontages and access driveways to be upgraded. Council’s
codes and polices also require the development to provide suitable frontage works.

In order to provide a suitable verge width, the property boundary at the corner of Factory
Street and Hill Street will need to be truncated. Conditions are recommended requiring a
footpath and kerb and channelling along the frontage of the site consistent with the
Department of Transport and Main Roads (DTMR) concurrence agency response.
Stormwater
The application includes a “Stormwater Management Plan” prepared by Aquaintel, which
shows a bio-retention basin and stormwater detention area within the eastern corner of the
site. The report details how the construction of the nominated works will not cause any off-
site water quality impacts or increase flows to adjoining sites, consistent with the outcomes
of The Noosa Plan.

Conditions are recommended requiring the development of the site to be undertaken in
accordance with the stormwater management plan, so as to achieve the recommended
water quality objectives and detention requirements.
Flooding
The subject site is affected by flooding from the adjacent Cooroora Creek during major rain
events. The applicant includes a ‘technical note’ prepared by TOD Consulting Engineers
outlining that the development involves all new buildings to be erected on stumps above the
1% AEP flood level.

The design allows flood water to flow freely through the site and avoids ponding on the
adjoining properties, consistent with the outcomes of the Natural Hazards Overlay code.
