Attention: Lisa Pienaar
Dear Lisa,
FURTHER ADVICE RESPONSE - DEVELOPMENT APPLICATION FOR A
MATERIAL CHANGE OF USE (DWELLING HOUSE) AT 24 PLOVER STREET,
PEREGIAN BEACH (LOT 5 ON P9313)
Further to Council’s Further Advice letter issued 23 May 2022, we now respond in full to each of the items
raised.
In support of this response, please find enclosed revised Proposal Plans prepared by Aboda Design
Group.
Please find below the response to each of the items raised by Council:
Item 1
Provide amended plans that comply with AO9.1 & AO9.3 (setbacks) of the Low Density zone
code or alternatively Acceptable outcome AO7.1 & AO7.2 of the code. Where there might be
an acceptable portion of 3 storeys, demonstrate compliance against PO7 of the code.
Response: The Proposal Plans have been amended as follows:
1. South Elevation - the door has been moved to the east, so as not to be within/under the three
storey zone. In doing so, the extent of cut within the side setback has been reduced, and will
ultimately minimise the appearance of 3 storeys;
2. North Elevation - the extent of the undercroft has reduced. The remaining zone will be a
ventilated crawl space only that is less than 2.0 metres in length (i.e. not a storey). The
northern elevation will present as two storeys.
3. Elevation/ Section presentation - the storeys in the background have been greyed out, to
better articulate two storeys.
We note that the proposal considers the existing topography, and is a typical construction form for a site
falling towards the rear of the site, which is also evident by surrounding properties. New landscaping is
provided along site boundaries where practical, and is integrated in the building design (in the form of
planters) to soften and screen the built form. This will assist in maintaining a vegetated skyline.

Although a very small portion of the building presents as three storeys from the south, the proposal is
within the 8 metre height limit, which does not result in an unreasonable obstruction of view lines and
does not result in overshadowing of adjoining neighbours. A low gradient roof pitch is proposed to keep
building height and bulk to a minimum as the site falls away from the frontage. The proposal presents as
two storeys when viewed from Plover Street.
Letters of support have been obtained from both adjoining neighbours in relation to the side setback
encroachments. Apart from the media room, which is a solid wall with no openings and has a length of
approximately 4.0m, the remainder of the side setback intrusions relate to eaves or planters. The setback
intrusions are not considered to adversely compromise the amenity of adjoining neighbours or cause any
privacy/overlooking concerns.
Item 2
Provide amended plans that comply with Acceptable Outcome AO5 and PO4 of the Coastal
Protection and Scenic Amenity overlay code (acknowledging only the stairs are accepted).
Item 3
Provide amended plans that do not include retaining structures on the rear boundary.
Response: The Proposal Plans have been amended to remove the portion of deck along the southern
side of the existing pool to be setback 6.0 metres from the rear boundary in accordance with PO4 of the
Coastal Protection and Scenic Amenity Overlay Code.
The pool deck to the northern side of the pool has been maintained (this section of deck can be
cantilevered if required). We note that this portion of the deck is less than 1.0 metre above ground level,
and does not go forward of the line of the existing pool as discussed on site. Refer to Figures 1 and 2
below showing this outcome. There is already an elevated pool and deck in this location, as we seek to
remove the elevated deck and replace it with a much lower deck very close to ground level.
Landscaping can be provided in the rear portion of the site where practical in accordance with PO5/AO5
of the Coastal Protection and Scenic Amenity Overlay Code.

Item 4
Submit amended plans that remove decks that are above ground level situated on the
boundary (and achieve a 6m rear setback). Any structure above ground level must meet the
setback requirements. The position of the decks does not comply with AO9.3 of the Low
Density zone code or PO9 a), b), c), d) or e).
Response: The deck to the south of the pool has been setback 0.5m from the southern side boundary.
Landscaping is proposed to provide privacy screening to adjoining residents. We note that the
Information Response previously submitted included a letter of support from the southern adjoining
neighbour, who acknowledged and provided support for the proposed encroachments.
Item 5
Provide amended plans that remove stairs outside of the property boundary.
Response: The Proposal Plans prepared by Aboda Design Group have been revised to remove the stairs
outside of the property boundary.
Item 6
Provide a site specific geotechnical report and site stability assessment for the site and
development. The report must include, but not be limited to:
a. recommendations for the construction and operational phases of the development to
ensure the stability of the subject site and the adjoining properties for the longer
term; and
b. details of the proposed structural solution to protect the structural integrity of the
existing sewer infrastructure running along the site’s eastern boundary.

Response: As previously advised in the Town Planning Assessment Report, and Information Response, in
accordance with Table 5.9.8 of the Landslide Hazard Overlay table of assessment, the proposal is for a
Dwelling House and code assessment is not required.
Tectonic has been engaged to prepare a geotechnical report and slope stability assessment. We request
that this is conditioned accordingly.
Item 7
Provide Unity Water’s approval for the proposed works over and adjacent to the existing
sewer line.
Response: The plans were updated as part of the Information Response to remove the deck to the east
of the existing pool. This has been replaced with turf/soft landscaping. As such, Unitywater approval is
not required.
We thank Council on behalf of the applicant for assessing the attached additional application material.
Based on the information provided in this application we respectfully request that Council proceed to
issue an approval.
Happy to meet with you via Teams to present the 3d model should Council have any further questions or
concerns.
Should you have any questions with respect to the above, please do not hesitate to contact me directly.
Yours faithfully,
Adapt Town Planning + Development Management
