Dear Nick,

I refer to Council’s further issues letter dated 17 May 2022 in relation to the above-mentioned application.

As you are aware, we have provided the attached response from Equilibrium Ecology to address Item 2 of the letter.

In relation to Item 1 of the letter, we submit that the information included within our Response to Information Request provided on 29 April 2022 demonstrates that the proposed development complies with Acceptable Outcomes AO4.1 or AO4.2 of the Flood Hazard Overlay Code. Please note that Section 5.3.3 (4)(c) provides that code assessable development that complies with the performance or acceptable outcomes complies with the purpose and overall outcomes of the code.

Please consider this a full response to council’s request and we as that Council proceed with deciding of the application at the earliest available Ordinary Meeting.

Should Council need an extension to the decision period for this purpose, we would be happy to provide a signed agreement letter.

We also request that Council include all the responses publicly available material on Noosa Council’s Planning Online System.
