Attention: Jodie Wilson, Senior Planning Officer

Dear Jodie,

Response to Second Request for Information – ‘Other Change’ to the Noosa Waste & Recycling Facility
at 561 Eumundi Noosa Road, Doonan, described as Lot 77 on SP298776

The purpose of this letter is to provide the further information requested by the State Assessment Referral
Agency (SARA) on 15 August 2025.

The response to the second request for information includes the following:

   • Updated advice provided by Rob Friend and Associates, including the relevant responses to State
       Code 16 (Attachment 1);
   • A series of Site Plans for the development showing the possible essentially management clearing and
the required bushfire management clearing for the existing development, proposed development and
       combined (refer Attachment 2 – inserted labels 2A, 2B & 2C);
   • The difference in the areas between the possible essential management clearing for the existing and
proposed development (refer Attachment 3); and
   • The relevant shape file for the affected area of regulated vegetation.

As stated previously, while the essentially management clearing is a relevant issue for the assessment of a
development application for a material change of use, the majority of the essential management clearing
applies to the existing development, which has approval (refer Figure 1). Further, it is also relevant that there
is a bushfire management plan approved for the existing development, which includes bushfire maintenance
along the northern boundary of the existing Cleanaway Depot, which is not substantially changing (refer
Attachment 2). It is accepted however, that there will be a small increase in the area of regulated vegetation
that could potentially be removed under the exempt clearing provisions under the Planning Regulation 2017
(refer Attachment 3).

Relevant Purposed Determination

As requested, a relevant purpose determination has been made to the Department of Natural Resources and
Mines, Manufacturing and Regional and Rural Development (the Department). It is noted that while the

request for a relevant purpose determination has been made, the applicant is not intending to clear any
additional regulated vegetation under the proposed development (refer Figure 1). This is because the extent
of regulated vegetation clearing that is being undertaken is limited to 12.4m from the northern boundary and
is primarily associated with the existing development. Further, remains within the area of the existing
development where essential management clearing could already occur.

It is questioned that Schedule 10, Part 3, Division 1, section 4 Item 2 is triggered given the only vegetation
that is being removed is limited to the area which is able to be cleared being essential management clearing
associated with the existing development (refer Attachment 2). In any event, a request for a relevant purpose
determination has been made under separate cover.

management clearing overlayed on the regulated vegetation

State Code 16: Native vegetation clearing

With respect to the request for further advice, the following additional site plans have been provided:

•   Exempt and necessary clearing associated with the existing Cleanaway Depot – Attachment 2A;
• Exempt and necessary clearing associated with the proposed development providing for a small extension
to the existing Cleanaway Depot to the west and alterations to the northeast area boundary of this area
    – Attachment 2B; and
• Exempt and necessary clearing for the existing and proposed development combined showing the
increase in the area of regulated vegetation that could potentially be removed under the exempt clearing
    provisions – Attachment 2C.

As part of the further information requested, a shape file for the above maps has also been provided. This
includes the location of regulated vegetation overlay. The extent of essentially management clearing that
could occur is marginally increased towards the northwest (151m²) and to the northeast (160m²) as a result
of the proposed development (refer Figure 1).

Mr Friend has provided amended advice about the mitigation of bushfire required for the existing and
proposed development (refer Attachment 2). This advice includes a photo of a person standing beside the

                                                                                                    2|Page

existing vegetation to demonstrate the vegetation has a height of about 16m (refer Attachment 1). This results
in an essential management clearing setback of 24m from the existing and proposed infrastructure.

The areas of regulated vegetation that could potentially be removed is marginally increased towards the
northwest and northeast. It is not intended that this vegetation will be removed and therefore should not be
required to be offset. Further, having regard to the advice from Mr Friend, the amount of vegetation clearing
required is for bushfire mitigation purposes only (12.4m in width) and will not have a significant residual
impact on the regional ecosystem in this location.

Subject to the further advice being acceptable to SARA, it is requested that the referral response be finalised
as soon as possible. This is subject to the relevant purpose determination also being provided by the
Department.

Should you require further information or have any concerns with the development proposal, please contact
me.

Yours faithfully
