RECOMMENDATION
That Council note the report by the Property Officer to the Planning & Organisation
Committee Meeting dated 13 October 2015 and approve the assignment of the existing
contract lease arrangement for Sunrise Neighbourhood Shopping Centre, Shop 2 -
Pharmacy, from KA & RJ Teed to Sunrise Healthcare Pty Ltd on or after 23 October 2015.
REPORT
The current lessee of Sunrise Neighbourhood Shopping Centre, Shop 2 – Pharmacy (Kerry
& Richard Teed), have a contract to sell the business operating as a Pharmacy to Sunrise
Healthcare Pty Ltd on or after 23 October 2015. The sale is conditional on the lease being
transferred to a new business owner, with settlement to occur as soon as Council provides
resolution. The Lease is not due to expire until 30 April 2016.
Kerry & Richard Teed started the Pharmacy at the Sunrise Shops in approximately 1996,
providing pharmaceutical services for the local community since that time. The proposal by
the purchaser Sunrise Healthcare Pty Ltd is to continue to provide pharmaceutical services
under the LiveLife Pharmacy brand, whilst supporting the local community and growing the
business.
In order for Council to consent to the assignment of the lease for the future operation of the
Pharmacy, the Property and Facilities section requested that the current lessee supply
Council with the proposed assignee’s details and the assignee was required to provide
references, financial information including a copy of the contract of sale, business plans etc,
to allow an appropriate evaluation of the assignees suitability to hold the interest or right to
lease Shop 2 as a Pharmacy at the Sunrise Neighbourhood Shopping Centre. These
documents have been received and assessed, with the assignee Andrew Feichter, owner of
the registered business Sunrise Healthcare Pty Ltd deemed suitable to hold the shop 2
lease.
A deed of assignment is to be executed by the current lessee, the assignee and Council,
once a Council resolution has been obtained. Under the pre-existing contract lease
arrangement Assignment Clause 12.1 (c) (ii) Council can enter into an assignment as long
as the entity is respectable, responsible and possessed of sufficient experience to run the
business to the same or better standard than the current lessee.
