SPECIAL MEETING AGENDA 28 OCTOBER 2019

Extent of vegetation removal
The Biodiversity Overlay applies to the site and seeks to ensure development is managed so as
to avoid, or where avoidance is not practicable, minimises or mitigates the impacts on the Shire’s
biodiversity values and natural resources. The proposed development requires the removal of
vegetation to allow for the development of roads and for services to be provided to each lot. The
applicant proposes to remove all vegetation to make the majority of the lots ‘development ready’
for the market. The applicant has provided the following figure with regards to the proposed
vegetation removal.

Figure 14: Details of vegetation removal (provided by applicant)
Areas to be cleared in yellow
The proposed complete clearing of all vegetation significantly limits the capacity for future
development to be consistent with the Noosa Plan which seeks for development of the SBC to
create a ‘park like setting’. It is considered possible for the lots to be made available to the
market with significantly less vegetation removal. The extent of vegetation removal is not
consistent with the outcomes of the Biodiversity Overlay and is not supported.
Lot layout and size
Broadly, the Reconfiguring a Lot code provides for outcomes which seek to enable lot
reconfigurations which facilitate development via suitable lot sizes which are able to contain
required infrastructure and for which appropriate access is provided. In this regard, it is noted that
10 of the proposed 24 lots do not comply with the minimum 4,000m2 size requirement.
When assessing the proposed development it is important to consider whether the layout, lot
sizes and shape enable the lots to be used for their intended purpose and developed in
accordance with the planning scheme requirements including setbacks to enable development
within a parkland setting.
