6.0 TOWN PLANNING ASSESSMENT
6.1 Level of assessment
Pursuant to the Advertising Devices Code in the Noosa planning scheme, the proposed signs
are defined as:
(a) 3 x Freestanding signs -
Medium Impact Sign;
(b) 1 x Below Awning Sign -
Medium Impact Sign; and
(c) 1 x Wall Sign -
General Sign.
The level of assessment table for the Noosa Heads Locality identifies that placing an advertising
d vice on premises, where not associat~d with a material change of use, is ’Self Assessable’ if
a ’General Sign’ or ’Medium Impact Sign’. Such development is ~Code Assessable’ if not
complying with the relevant criteria in the Advertising Devices Code or, is a ’High Impact Sign’.
This application is code assessable for a Medium Impact Sign and a General Sign on the basis
that the proposal provides some alternative design solutions to the acceptable solutions
identified in the Advertising Devices Code.
As set out in section 313 of the Sustainable Planning Act 2009, code assessable development
is assessed against the applicable codes of the planning scheme. In this instance, the
applicable code is the Advertising Devices Code.
6.2 Locality and Zoning Classification
The subject site is located within the Visitor Mixed Use Zone of the Noosa Heads Locality of the
Noosa Planning Scheme.
The Noosa Heads Locality Code identifies overall outcomes for the Noosa Heads Locality and
the Visitor Mixed Use Zone. While the level of assessment table does not identify the Noosa
Heads Locality Code as being applicable to the assessment of the application, it is considered
worthwhile to note that the proposal is consistent with the following overall outcomes of the
Noosa Heads Locality Code:
(a) New uses and works being located, designed and managed to:
(i) be compatible with other uses and works;
(ii) maintain the safety of people and works;
(iii) avoid significant adverse impacts on the amenity enjoyed by users of other premises,
including acoustic and visual qualities.
(b) Hastings Street’s character of low rise buildings, vibrant streetscape, mix of indoor and
outdoor activities, diverse dining opportunities, specialty retail businesses and pedestrian
links to Main Beach is maintained.
(c) For the Visitor Mixed Use Zone, development:
(i) Contributes to a high level of residential amenity, design quality, landscape quality and
safety;
(ii) respects the scale and character of the streetscape and surrounding development;
(iii) incorporates entertainment and dining businesses, retail businesses and commercial
businesses that are of particular interest to visitors;
(iv) contributes to the economy of Noosa through the tourism and hospitality sectors.
