Bus Stop Expresso Objection
Attached to the e-mail PM Submission - Joyce Brumley - MCU21/0194.01.
Joyce Carolyn Brumley 191 Mary River Road, Cooroy 4563 Queensland 9/8/2023 The Chief Executive Officer Noosa Shire Council P.O Box 141 Tewantin QLD 4565 Attention: Jada Lyons Dear Jada, Council Reference: MCU21/0194.01 Thank you for the opportunity to have my say. | write in connection with the above development application. As a neighbour with shared access (Wurli Court), | know the location well and | wish to strongly object to the expansion of this business on the following grounds. 1. Loss of Privacy Safety and Security: The current development has already led to significant reduction in privacy, safety and security for me and my children. An expansion would generate more traffic and could lead to greater privacy, safety, and security issues. Cars park on the road verge of my home, road shoulders and sometimes in my driveway. The business also has sitting at the back where customers can overlook into my home. Customers have also wandered into my property and posed a risk to my children e.g., on the 28" of July 2023 during school holidays while | was at work, 2 strangers walked into my property and watched my daughters playing on their aerial silks. My children have been afraid to play outside since this incident (reported to the Cooroy Police Station). 2. Deprivation of access into my property: The business owners, their agents, and clients hinder my access. Customers Park in blind spots, too close on the shoulders of the road and even at the entry into my driveway. This causes a safety risk for me and my children in case police, fire or ambulance service is needed. While the actions of the customers are innocent due to presumptions that the business owners are also the landowners of Lots 1, 3 and 5, (see attached Facebook comment on Coroy Community Notice Board dated 22 July 2023 made by an outstanding member of the community as well as staunch supporter of the business), the actions of the business owners are deliberate as | have requested them to not block my access and to help sort out the parking problem. Instead, they continued to carry out acts like parking their cars in my driveway and placing their rubbish bins in a manner that denies me access via Wurli Court and forcing me to use an alternate unplanned entry that is too close and

unsafe to turn off into from the Bruce Highway Overpass when traveling at 80km/hr (See text messages as well as photos of their cars and rubbish bins. Also, see REF RM2023/08988 for earlier complaint made to council). 3. Road safety/traffic: My children cross the road to the Rural Fire Station where they catch the school bus at approximately 7:45am. The roadside business is open from 5.30am every day and my children are faced with the daunting task of manoeuvring traffic going by at 80kms/hr as well as the extra traffic by customers pulling in or crossing lanes into the Bus Stop Espresso. This has become a very stressful event for them, and | feel the situation at this location has created a hazard which will only get worse when the new road at Black Mountain is opened due to more traffic into town. If you need to verify pick up location for my sons Taj Brumley and Ely Brumley, the Bus Company has agreed to be contacted on 0429154060 — Mr Rob Cochrane or you can call their office on 54479870. 4. Incomplete Business Development application/proposal: One of the requirements for a development application is a detailed report of potential impacts upon neighbours and the surrounding neighbourhood (Home Based Business User Guide November 2016). The oversight of a neighbourhood impact assessment exhibits that this development does not consider important matters such as its impact on its neighbours and road users. This application has also omitted crucial information on its submitted plan as it’s address is also the location for an industrial activity that emits toxins from coffee roasting which is done at a commercial scale without council approval. This activity also creates a health risk to my children. Furthermore, the business application also failed to provide an updated traffic assessment which is the main problem with its location. As a neighbour, | have experienced first-hand the amount of traffic generated and the possibility of future problems and liabilities is high if this application is granted. 5. Location: The business trading address is 201 Mary River Road, not Wurli Court. Mary River Road is an 80km/hr zone and roadside stalls are not proposed in areas with such speed limits. This roadside business is also in proximity of other major amenities. There is not enough separating distance between the roadside business, the waste transfer station situated across the road as well as the rural fire Station that is also situated across the road and is the location for the school bus pick up. The concentration of use is currently extreme in relation to demands on the road. There is no need for a food and drink outlet on Mary River Road as the same service is available at several drink and food outlets very close by such as Fox and Hound, Jamaica Blue, Fika Café, German Bake House as well as the Bus Stop Espresso’s own other food and drink outlet; “Wild Tree Café” located at 46 Maple Street Cooroy. 6. Character, amenity, and concerns for over development: The business does not fit within the established character of the area, and it is also out of context for the location. The site has 2 structures; a moveable bus as well as a permanent shop that is still in the process of being built. The magnitude of the
Page 3
structures together with the excessive numbers of cars parked on the road reserve is visually exhausting for a rural setting. It impacts on my privacy, devalues my property, and may lead to an increase in my house, home contents and car insurance. During the night, the bus lights are left on (see image) and this distracts from the scenic amenity and disadvantages the Koala corridor on my property. For business purposes of this magnitude, this rural zone does not meet the requirements needed including safe speed zones for traffic, walking pathways for pedestrians, designated parking spots nor any appointed authority presence to overlook business practices, parking and the safety of the public accessing the business. 7. Public Health and Food Safety: Outdoor dining in a dusty environment due to erosion of road reserve caused by excessive car parking and there is an obvious lack of toilet facilities to accommodate both staff and the number of customers. It is my hope that this application is denied as it does not meet the overall outcomes required for a roadside stall/food and drink outlet for the rural zone. If this application is approved, what remedies is council going to put in place to protect my interests as a resident living in the rural zone? Should you have any questions in relation to my objection, please do not hesitate to contact me on 0408248420 or via my email: [email protected] Yours Sincerely, gety Joyce Carolyn Brumley

2:35 © & te “8 il 80% mi Me 3:43 pm, 4 Apr Hi Rob. Following our conversation on Sunday, please refer to the map above that you and Beth would have. It clearly shows the council approved entry and exit to my property. When we spoke, | informed you that | was fencing off for safety reasons. You were however adamant about where my boundary ends and where you park your car. | feel | have been a good neighbour and a little empathy, as exhibited by lan would have gone a long way but | understand now Business first! And | do wish you all the best with that always however my children’s safety is my number one priority and as such, | will be fencing off hopefully sooner than later after getting clearance with the council and | intend to use my entry and exit point and would appreciate it if you did not block it anymore. Thanks and have a good evening. i) < Copy text Share HI O <

2:34 @ & vod 48) 81% Me 7:24 pm, 4 Apr Yes Rob but where you park your car is not you designed parking spot. Its a council approved easement for me to be able to get in and out of my property. Therefore not a designated parking spot. lf council says otherwise (the entry to my property can be blocked by cars) then I shall stand corrected. Again, my priority is the safety of my children. | am sure any parent would be very understanding of that. Have a good night. a < Copy text Share I O <
