Subject: MCU19/0013 - Appeal Request

This request is being made in accordance with section 75 of the Planning Act 2016 (change representations).

Reference is made to MCU19/0013 (attached), condition 19, specifically 19a (written below)

Opal Street must be upgraded for the length of its frontage to the subject site. The works must be undertaken in accordance with an Operational Works approval and must include in particular: a. kerb and channel on an alignment that is an extension of the existing kerb and channel to the west of the subject site and joins smoothly to the kerb and channel to the east of the site.

I am requesting for removal of the condition/requirement for kerb.

The reason for this request is based on the following information:

1) 8 Opal St was not required to provide kerb, and does not currently have any kerb (plan attached showing channel only), thus making the condition (19a) of the MCU19/0013 impossible to comply with; and
2) Only one other residential property in Opal Street has kerb (12 Opal St), thus indicating that kerb does not fit with the general visual aesthetics of the street.
