CLOSURE OF THE MEETING TO THE PUBLIC

That the meeting be closed to the public pursuant to section 275 (1) (h) of the Local Government
Regulation 2012 for the purpose of discussing Item 8.1 - Closed Session Item: Pomona Flood Mitigation.

RE-OPENING OF MEETING TO THE PUBLIC

1    POMONA FLOOD MITIGATION

     Council Resolution

     Moved:              Cr Wellington
     Seconded:           Cr Bolton
     That Council note the report by the Project Manager to the Ordinary Meeting dated 31 July
     2014 and:
     A.     Delegate authority to the Chief Executive Officer (CEO) to negotiate and finalise the
            acquisition of the whole of the site described as Lot 20 on RP800332 and Lot 24
            RP35098; or
     B.     Failing a negotiated settlement, delegate authority to the CEO to proceed by a
            compulsory land acquisition to acquire the whole of the property described as Lot 20
            on RP800332 and Lot 24 RP35098 in accordance with the requirements of the
            Acquisition of Land Act 1967 and if no objections are received to compulsorily acquire
            the properties; and
            1.     Delegate authority to the CEO to make application to the Minister for Natural
                   Resources and Mines to take the land under Section 9 of the Acquisition of
                   Land Act 1967; and
            2.     Delegate authority to the CEO to settle the final claim for compensation.
     C.     Request staff to provide a detailed design for Council’s consideration prior to
            proceeding with the project.
