Hey Shane,

As requested, this email provides an overview of the proposed stormwater quality strategy and related discussions with Noosa Shire Council’s Cherie O’Sullivan.

I hope this helps.

Just let me know if you need anything else.

1.	Stormwater quality-related objectives and requirements: The proposed development must comply with the Noosa 2006 Plan, appropriately ‘protect and enhance’ downstream lake water quality, and all proposed SQIDs must be appropriately maintained.

a.	As per the phone meeting (20 August 2020, with Council’s Cherie O’Sullivan, Acor’s Shane Suffolk and Ocean Protect’s Brad Dalrymple – see notes attached):

                                                         i. the proposed development is not required to achieve State Planning Policy (SPP) pollutant load removal targets

ii. the proposed development (and potential stormwater management strategy) should ‘protect and enhance’ downstream water quality (relative to existing site)

*	achieving this should be acceptable to enable an operational works approval to be issued with no change to the MCU DA approval

a.	As per the aforementioned phone meeting, subsequent discussions with Cherie, and Council conditions, any proposed stormwater treatment devices on site must be maintained at a recommended frequency for the life of the development in accordance with a Maintenance Management Plan to be submitted to Council for endorsement prior to issuing the OPW permit.

                                                         i. As per Council’s condition “The Maintenance Management Plan must be prepared by suitably qualified RPEQ in accordance with the manufacturer’s design/maintenance manual and the recommendations of the accreditation body, the owners and successive owners are responsible for the required ongoing maintenance and achieving the pollution targets. Logs of all maintenance, performance checking and filters replacement must be submitted for Council’s record”.

c.	In her email (16 September 2020, see attached “RE: Proprietary Products & Compliance with SQUIDEP”), Cherie advised that the proposed stormwater quality strategy needs to comply with the 2006 Noosa Plan.

2.	Feasibility of bioretention basins (or other vegetated WSUD assets): Based on detailed site analyses, bioretention basins would be inappropriate for the site – particularly given that the site utilises ‘pit and pipe’ drainage (i.e. not sheet flow for entire site) and this subsequently means deep invert for any pipe discharging to a potential bio basin.

a.	As agreed by Council’s Cherie O’Sullivan, Acor’s Shane Suffolk and Ocean Protect’s Brad Dalrymple in the phone meeting (20 August 2020 – see notes attached), no-one (Council, developer, community) would want deep bio basins like those that would like occur at the site – due to reduced amenity, public safety etc

3.	Proposed Stormwater Quality Strategy: the proposed stormwater quality strategy for the site is a ‘treatment train’, consisting of:

a.	A 7xStandard(460) PSorb cartridge StormFilter <https://oceanprotect.com.au/stormfilter/> system within a precast DN2250 manhole
b.	6 <https://oceanprotect.com.au/oceanguard/> OceanGuards with 200micron mesh bags (OG-200), installed within each of the 6 gully pits within the site.

4.	Predicted performance of strategy: the strategy has been designed to achieve standard State Planning Policy (SPP) targets of 80/60/45/90% reductions of average annual TSS/TP/TN/GP loads respectively, and also achieves a significant decrease in pollutant loads discharged to Lake Weyba (relative to the existing site).

a.	The strategy achieves the SPP targets despite that, as outlined above, the site doesn’t have to comply with SPP targets
b.	Further detail in relation to the predicted performance and associated modelling is provide in the attached email “14977 – Cnr Mary & Weyba Rd, Noosaville (BP Noosaville)”

5.	Information supporting performance claims of proposed SQIDs: Council has advised that the pollutant load removals for the proposed strategy will not be interrogated and no SQIDEP endorsement letter will be required for the proposed devices.

a.	A previous Council condition (provided to Acor) in relation to the proposed development stated that “Any adopted proprietary device must be supported by documentation of evaluation and endorsement by Stormwater Quality Improvement Device Evaluation Protocol (SQIDEP). Provide supporting evaluation and documentations for the proposed Ocean Project device”.
b.	This condition was inconsistent with previous advice from Council’s Cherie O’Sullivan (in phone meeting, 20 August 2020)
c.	Brad and Cherie have subsequently had follow-up correspondence/ discussion to confirm Council’s requirements:

                                                         i. In an email from Cherie to Brad (13 September, see attached email “RE: Proprietary Products & Compliance with SQUIDEP”), Cherie confirmed that “Where a development application does not need to meet pollutant reduction targets, we will not be assessing the performance against SQUIDEP”.

ii. In an email from Cherie to Brad (17 September 2020, see attached email “RE: Proprietary Products & Compliance with SQUIDEP”), Cherie wrote that she had “let the assessing officer know the pollution reduction targets do not need to be met for that site (under the 2006 Noosa Plan) therefore the pollutant reductions will not be interrogated”.

iii. Brad provided Cherie an email in response (17 September 2020, see attached email “RE: Proprietary Products & Compliance with SQUIDEP”) providing supporting information in relation to the proposed Ocean Protect devices, and seeking clarification that the proposed strategy (of OceanGuards and StormFilter) is ok

iv. Cherie called Brad (on 22 September 2020) confirming that the pollutant reductions will not be interrogated and that no SQIDEP endorsement is required for the proposed Ocean Protect devices, and that that she couldn’t see any problems with the proposed Ocean Protect devices – and that she would advise Council’s reviewing officer of this.

6.	Compliance with 2006 Noosa Plan: The proposed stormwater quality strategy will comply with relevant parts of the 2006 Noosa Plan.

a.	This is described in Brad’s email (17 September 2020, see attached email “RE: Proprietary Products & Compliance with SQUIDEP”)

7.	Maintenance of Ocean Protect devices: As per Council’s condition, an appropriate maintenance plan is required, with evidence provided to demonstrate ongoing compliance

a.	Operation and maintenance manuals are provided in the reports given in Brad’s email (17 September 2020, see attached email “RE: Proprietary Products & Compliance with SQUIDEP”)

*	Ocean Protect can provide a quotation to undertake necessary maintenance requirements, upon request.
