                Compliance Assessment
5.1 Commonwealth Regulatory Requirements
The Site does not support and MNES as defined by the EPBC Act.
Whilst the adjacent section of Castaways Beach provide habitat resources that would be utilise by several
MNES fauna species any MNES listed species utilising the Castaways Beach foreshore are well buffered from
the proposed development by approximately 100m of coastal dune system and as such no significant adverse
impacts are anticipated.
Some MNES species may occasionally utilise the food and shelter resources available within the vegetated
coastal dune system. In respect of such species the proposed development is not likely to have any significant
adverse impacts for the following reasons.
1. The Site has a history of use and development for residential purposes and whilst the proposed
development represents an intensification of such uses the scale of intensification is considered minor
given that the proposal is for a relatively small number of detached residential dwellings.
2. The Site occupies a relatively small proportion of the coastal dune system and any loss of habitat
resources would be very localised in nature and minor in scale.
3. The existing width of the coastal dune system to the east of the Site would be maintained which is
       sufficient to:
       a. preserve north-south movement opportunities along the coastline (n.b. in places to the north and
south of the property the width of the coastal reserve is approximately 50m); and
       b. buffer any shoreline species (e.g. migratory shorebirds, nesting marine turtles) from direct or
indirect disturbance during the construction and occupational phases of development.
4. The Site does not support any habitat resources that are not readily available elsewhere within the
extensive areas of public land that encompasses the coastal dune complex that extends along the
shoreline to the north, east and south of the Site or within the Noosa National Park to the west of David
       Low Way.
Given the above facts and circumstances and with reference to the Significant Impact Guidelines 1.1 - Matters
of National Environmental Significance (DoE, 2013), the nature and scale of the proposed development of the
Site is not likely to have any significant impacts to MNES.

5.2 State Regulatory Requirements
There are a number of specific State Interests that need to be considered as part of this ecological assessment
of the proposed development. In this respect Table 5-1 provides a summary of the manner in which the
proposed plan of development responds to applicable State regulations and associated State Development
Assessment Provisions – Version 2 (SDAP) with a biodiversity conservation focus.

Fisheries Act The Site does not support any marine plants or land subject to tidal Complies – no
influences, and the proposed plan of development does not involve assessment requirements.
any works within Burgess Creek. As such the proposed plan of
development does not trigger assessment against either:
