Name Case Management Working Group
Goals The overall goal of the Working Group is to effectively manage
Council's planning disputes.
Specific goals:
e Development appeals and disputes are systematically
managed;
e There is a regular review of cases to ensure they are
managed properly;
e Development and review of appropriate strategies to
manage appeals; and
e Optimise efficiency of Council’s planning cases to reduce the
financial impact on Council.
Roles & Responsibilities The Working Group’s roles and responsibilities include:
e Overview from a strategic standpoint, development disputes
after Council has decided an application;
e Receive regular updates from Council's Solicitor and
Planning staff concerning the ongoing management of
development disputes;
e Review the strategies and tactics in upcoming court cases;
and
e Ensure Council's resources are used wisely in planning
cases.
Resources The Working Group will generally operate based on Council's
own staff resources. The intention is that the Working Group
will be able to save Council money through the careful oversight
of planning litigation.
Timeframes The Working Group is likely to be required in the long-term as
Council will continue to have development issues into the future.
However, it would be appropriate for there to be review of the
Working Group’s effectiveness after a twelve month period.
Limitations The Working Group does not have any delegation to decide to
commence or settle planning cases. Those decisions will be
made by Council.
Reporting to Council Routine reports to Council on progress with addressing
development disputes could be expected on a three-monthly
basis. However, the Working Group may need to report to
Council on more specific issues as required.
