SPECIAL MEETING 12 DECEMBER 2024 part within the Environmental Management and Conservation zone. Submissions Some submissions supported the extra level of protection through the zone, however some neighbouring owners were concerned about the impact on their ability to carry out rural uses with increased setback requirements. Response Rural owners with voluntary conservation agreements were given the opportunity to have some of their property rezoned to Environmental Management and Conservation, and some have taken up this offer. Greater boundary clearances are required for buildings or in some cases animal uses from boundaries that adjoin neighbouring properties in the Environmental Conservation and Management zone. This is intended to protect national parks and nature reserves. The proposed amendments inadvertently resulted in increased boundary setbacks of 100m and 20m which would have the effect of limiting normal rural activities such as housing animals and storing machinery on adjoining land. It was not intended to penalise property owners who may be carrying out rural land uses and be unfairly affected by increased building setbacks. Therefore, the greater setbacks should not apply if it is private conservation land. However, it is considered reasonable that rural activities be setback from land within government ownership within the Environmental Management and Conservation zone, such as National Parks. The owner of a property with a voluntary conservation agreement over Lot 2 RP40869 requested a realignment of the Environmental Management and Conservation zone, which is considered reasonable and is supported. Recommendations It is recommended that a change be made to the proposed amendments to: - revise specific building setbacks for the boundary of adjoining properties in the Environmental Management and Conservation zone where such land is in State or Local Government ownership; and - revise the Environmental Management and Conservation zone on Lot 2 RP40869. Miscellaneous, clarification and error corrections - Attachment 3 A number of minor miscellaneous clarification and errors were also identified in the post consultation review process which are proposed to be amended. In addition, the recent Planning Regulation amendments of 2 August 2024 which mandates that home based businesses are capped at either accepted development or code assessment (ie. they cannot be subject to impact assessment) requires some changes to Noosa Plan 2020 to reflect this, including a review of the Home based Business Code to strengthen provisions for high impact home based business. These proposed changes are outlined in Attachment 3. Process for adoption of the proposed amendments Following Council's consideration of this report and endorsed of the changes to the proposed amendments, a Consultation Report will be prepared, made available on Council's website and submitters will be notified. The endorsed changes will be made to the proposed amendments, including consequential changes, and together with the Consultation Report, will be forwarded to the State Government for Ministerial approval for adoption. A report on the proposed changes and how they relate to any relevant regional or state plans, state planning policies and state interests will also be prepared and forwarded to the
