I refer to your application and advise that Council wishes to provide you with further advice
about the application in accordance with the provisions of the Development Assessment Rules
2017.

Issue – Noise Impacts
It is noted that the Acoustic Report provided with the Information Request response includes
a noise limit of 43 dB(A) for the 10:00pm to 12:00am period. This limit is higher than the
evening noise limit of 39 dB(A) on the basis of the logger results at Monitoring Location B
nearest the houses to the west. The use of 43 dB(A) is inconsistent with the evening noise
limits, which should be the same or lower limits for the evening period should apply ie a
maximum 39 dB(A) should apply.
It is noted that the noise predictions on page 17 for vehicles on the access road predicted at
the Eastern Residence at 642 Louis Bazzo Drive, the predicted levels are 40 dB(A) for 20 cars
and 40.9 db(A) for 18 cars and 2 coaches. Similarly, for 10 staff cars the predicted level is 40
dB(A). On this basis, non-compliance with the evening criteria is demonstrated and similarly,
non-compliance with similar or lower noise criteria in the 10:00pm to 12:00am period is
demonstrated.
Further to the above, the analysis of vehicles on the access road has not provided predictions
of LMax levels for cars and coaches at the nearest residence, noting it is in the post 10:00pm
period where the sleep disturbance criterion of 50 LA Max applies.
