GENERAL COMMITTEE MEETING AGENDA 16 JANUARY 2017
Of these, the statutory planning instruments relevant to this application are discussed in the
sections that follow.
3.2. State and Other Statutory Instruments
State Planning Policy
State Planning Policy mapping identifies the following applicable layers:
Climatic regions – stormwater management design objectives
Flood hazard area – Local Government Level 1 and Local Government flood mapping area
The above State Planning Policy has been deemed by the Minister for Local Government and
Planning as appropriately reflected in the Planning Scheme and therefore does not warrant a
separate assessment.
South East Queensland (SEQ) Regional Plan 2009 - 2031
The site is located within the Urban Footprint area of the SEQ Regional Plan and the proposal is
consistent with the regional policies of the SEQ Regional Plan.
3.3. Statutory Instruments – Planning Scheme
The subject site is located in the Noosaville Locality, is zoned Shire Business Centre and within
Precinct E4 of the zone. The proposed industrial use (brewery) is identified as a consistent use
within the precinct and would be required to follow a code assessable application process.
However, the proposed food and beverage component, being for the tasting room and kitchen, is
an inconsistent use in Precinct E4 and the application is therefore required to follow an impact
assessable application process. It is noted the development as a whole (combined industrial use
and food and beverage use) is not consistent within any zone of The Noosa Plan.
Locality Provisions
The planning scheme seeks to ensure that uses in Precinct E4 provide for an expansion of the
Noosaville Industrial estate and are compatible with the Business Uses existing in Precinct E3 such
as the retail and commercial uses within the Noosa Civic shopping precinct.
The Noosaville Locality Code is most relevant and provides the following overall Outcomes for new
uses:
Overall Outcome 11.7.2 reads:
11.7.2 The overall outcomes sought for the Noosaville Locality are the following—
a) New uses and works are located, designed and managed to—
i be compatible with other uses and works;
ii maintain the safety of people and works;
iii avoid significant adverse impacts on the amenity enjoyed by users of other
premises, including acoustic and visual qualities; and…
vi provides important industries and service-related businesses to the whole of
Noosa, but particularly the coastal area and the north-east area of the former
Maroochy Shire
AND
Specific Outcomes O146, O147 & O148
O146 Development provides for the expansion of the Noosaville Industrial Estate;
O147 Development in Precincts E4 and E5 recognises the role these precincts play in linking the
