A copy of the existing approved plan (Dwg No. M1717E5 L01 A) and a copy of the amended plan M1717E5 R01 D are enclosed for Council’s consideration. The nature of the proposed amendments are as follows: The works associated with this approval are being undertaken in a staged manner, with the final stage of works (i.e. Stage 5) yet to be completed. Notwithstanding this, it is noted that the works associated with this approval have been “substantially started” in accordance with the provisions of the Sustainable Planning Act 2009, being the relevant legislation that applied when the approval was issued. On behalf of our client, Country Club Villages, we hereby request a “Generally in Accordance” determination of plan amendments that have been made to reflect the most recent change to the higher order Development Approval (Council Ref: 132004.5744.11) issued by Council on 24 February 2021. Please find outlined below the basis of our request. 1.0 SITE / APPROVAL HISTORY The site is situated at 35 Walter Hay Drive, Noosaville and is described as Lot 2 on SP162077 (“the Site”). The total area of the site is 6.707 hectares. On 21 December 2005, Council issued a Negotiated Decision Notice for a Material Change of Use (Retirement Community – 169 Dwelling/Accommodation Units and Ancillary Facilities) development approval (Council Ref. 2004/5744). On 28 January 2016 Council approved a change to the development approval to reduce the number of proposed villas by
four, alter the proposed villa types and ancillary uses with the inclusion of a manager’s residence. The amendments
resulted in a combined site cover of 20,945m2 and a GFA of 19,575m2, both less than originally approved.
There have been a number of minor changes to the Development Approval (MCU) since the original approval was
granted, with the most recent change to this approval issued by Council by correspondence dated 24 February 2021
(Council Ref: 132004.5744.11). The most recent change to Approval specifically sought to relocate the 20 car parking
spaces for Building B, towards the front boundary on Eenie Creek Road. This revised location reflects the position and
number as previously approved by the original Approval issued 2005. The revised layout has also been designed to reflect
the existing layout approved as part of Building A.
2.0 DESRIPTION OF PROPOSAL
In recognition of the most recent change to the higher order MCU Approval (Council Ref. 132004.5744.11), we note that
the approved operational works (OPW) plans need to be amended to reflect the changes to the approved development
layout. Accordingly, we have updated the set of approved OPW plans, specific to Stage 5, to incorporate the changes
sought by this request. To assist Council’s assessment of the request, consequential changes to the list of approved plans
are highlighted below via strikeout for deletions and bold-type for new inclusions.

In view of the minor nature of the proposed plan changes, which have been undertaken to align with recently approved
changes to the higher order MCU Approval, we request Council’s written confirmation that the enclosed plans are
‘generally in accordance’ with the approved Operational Works package. This will then allow our client to continue with
construction of the final stage of the development.
We can confirm that Generally in Accordance fee of $631.00 will be paid upon receipt of the payment advice from
Council.
