PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 9 JULY 2019 Energex The initial application was referred to Energex for Advice as an Energex transmission line traverses the site. Energex responded on 6 June 2019 advising that it has no objection to the extension of the sunset clause. Current Application Under the Planning Act 2016 this change application is not required to be referred to the referral agencies for comment. 7. CONCLUSION & REASONS FOR DECISION This minor change application for 152006.1999.03 relating to Development Permit for Reconfiguring of a lot (52 lots & park) for 191 Hollett Road Noosaville seeks to extend the existing sunset clause and is recommended for refusal. The development is not consistent with the South East Queensland Regional Plan or the Noosa Plan (2018) and there is insufficient justification for the proposed development. Council has identified that there is no need for additional subdivision outside the Urban Footprint as Council is able to meet the projected population targets within the Urban Footprint. Accordingly, the development is not in the community’s interest. Furthermore, it is considered that the community have insufficient awareness of the proposal. It is noted that previous applications to extend the currency period of the approval were refused and are currently under appeal. Should the Court, when deciding these appeals, agree to extend the currency period it would be possible for the sunset clause to also be amended at the same time.
