PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 9 JULY 2019
Application No Applicant Application Details Fees & Charges Fee
Policy proposed
RAP17/0512.01 7 Allambi Rise Change to RAP for a $1001 $0
Noosa Heads Detached House
Council issued a Concurrence Agency Approval for a Detached Dwelling. A condition of approval
included requiring the applicant to submit an Operational Works application for landscaping prior to the
issue of a Development Permit for Building Works.
Under the Planning Scheme, landscaping for detached dwellings is not assessable development and
therefore the condition is not lawful.
The applicant has requested a change to the approval to have the condition deleted but have also
indicated that they would accept an alternative condition requiring the site to be landscaped with some
mature planting. Given the condition is not lawful, it is agreed to waive the full application fee.

Council issued a Development Approval for a restaurant on 18 August 2016. This request is to remove
2 conditions – one relating to hours of operation and another relating to a sunset clause. The application
raised a number of public submissions at the time of assessment, which will need to be considered as
part of the change application. The proposed changes will also require discussions with Liquor
Licensing and a report to Council.
The applicant has requested a reduced fee for the change to the approval to $852, but due to the
amount of work required in the assessment, the requested fee variation is not supported.
Application No Applicant Application Details Fees & Charges Fee
Policy proposed
Operational Works Marara Street Op Works – Sealing of $1035 OPW Base $0
– not yet lodged Cooroy Road fee
The applicant is seeking to seal the road from the cul-de-sac to the church carpark to ensure dust is not
an issue for the two residential properties at the end of the street.
The current development approval for the church does not require the road to be sealed and sealing of
the road will benefit the community particularly the neighbouring 2 residents. While an Operational
Works application is still required to ensure the works are appropriately constructed, the proposed fee
variation is agreed to given the benefits to neighbouring residents.
