elements. Further applications will be required to address stormwater, access, car parking and
landscaping.
As the works across the site will be the subject of a number of applications, there is some merit in
reducing the fee for each application. However in order to ensure assessment the current application
and any subsequent application.
The 25% reduction would also be an incentive for the applications for the remaining works to be
submitted as a single application.

The applicant has requested Council consider the minor change fee instead of the major fee including
a 25% discount for development within an existing building, thereby suggesting a fee of $1968.00
less 25% = $ 1476.00.
The applicant states that the application relates to the change of an existing condition, wanting to
permanently cover an outdoor area, which is approved as a restaurant.
The applicant advises that there is no expansion of use area and should be considered to be minor
in nature with limited assessment required.
The site has an approval for a Multiple Dwelling (18 units), Accommodation Building (18 units),
Shops, Restaurant and Ancillary Facilities. It was approved in April 1998.
Condition 4 of the approval states: ‘The uncovered dining area on the northern side of the building
must not be roofed or covered by any form of structure. (Umbrellas not exceeding a dimension of 3.0
metres are permitted).’
The proposed changes will increase the site cover for the site beyond the Noosa’s Plan’s outcome
and may require a report to Council. Therefore a reduce fee is not supported and the 25% discount
does not apply to changes applications.

                                                                   Policy proposed

The applicant has requested a fee reduction of 50% from the scheduled fee, which would amount to
$3278.50. The application stems from a complaint about a real estate office operating from an
existing building within an established garden centre.
The property is zoned Detached Housing where an office use is identified as an inconsistent and
would normally be subject to a multiplier of 3 (totalling $19,671).
The applicant advises they believed the zoning to be commercial when they took out their lease.
It is suggested the 50% reduction of fees would be reasonable as there is limited assessment
required due to the small size of the real estate office (29m²), with one real estate agent and no
changes proposed to the site layout.
